This Reorganization Meeting of the Township Council of the Township of Vernon was convened at 12:00 p.m. on January 1, 2023 via Zoom Webinar and in the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey.

STATEMENT OF COMPLIANCE

Adequate notice of this meeting has been provided to the public and the press on January 6, 2022 and was posted on the bulletin board in the Municipal Building in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-7.

OUTGOING COUNCIL PRESIDENT COMMENTS

As we bring our 2022 Council year to a close, I look back on this past year as council president as a year of varied results. In many cases we were required to deal with ongoing issues in personnel, township matters yet to be complete and projects that although not of our making did require our oversight.

Looking forward to 2023, I believe that we can reset township priorities to address the needs of a wider segment of our community. The completion of the new Pump track and the Walking and Bicycle path on Rt 94 provides many in our community with an opportunity for vigorous activity. With our diverse fields and varied facilities, our youth can take part in many different sports on a number of different competitive levels. Perhaps it is now time for Vernon to look to some other areas of recreational opportunity. About six years ago I introduced a proposal to recognize the outstanding work and commitment of the men and women of our local Vietnam Veterans of America Chapter 1002 who began in 2012 to work to fill a very real need for a cemetery as a final resting place for their deceased brothers and sisters. As we all know that need has been achieved with a beautiful facility that now exists in Sparta, NJ.

The council and I believe that this selfless commitment needs to be recognized by returning veterans who have never heard the words, "welcome home" on their return from foreign shores. In recognition of their heartfelt service, the Vernon Council would like to see the start of construction in 2023 of a Band Shell that I proposed about six years ago as a "unity project "to honor the members of this chapter who have made us all so very proud. The Band Shell would be located on the great lawn at Maple Grange Park and would be dedicated to and named the Vietnam Veterans Memorial Band Shell. This structure will be used by residents of all ages from preschoolers through our growing senior citizen population.

To that end I am asking the council that the sum   of $300,000 be appropriated, with council approval, in our current budget with a stipulation that funding also include grant money to offset cost to our taxpayer. Hopefully we will be able to secure enough private funding and community donations to eliminate any tax impact. As a gesture of my commitment to this project I have contacted and have secured commitments for $15,000.00 dollars towards this “Unity Project” from two individuals who have most generously and happily given to this most worthwhile project. I have also submitted a request for further funding assistance to a private foundation. With this initial commitment and the possibility of additional aid, perhaps residents of the township as well as other township businesses will be moved to join in also providing financial support. With that expectation a grant line will be established in our budget to support this effort.

This project will, I believe, provide a basis for many activities, recitals for youngsters, musical and choral presentations, readings, plays and film showings while enriching the character of our community. It is my sincere hope and I am sure that of the council's and administration this project be completed and scheduled for dedication this late fall.

Council Member Tadrick would appreciate Ms. Paladini’s assistance.

DESIGNATING MEETING DATES OF THE TOWNSHIP COUNCIL FOR THE 2023 CALENDAR YEAR

BE IT RESOLVED, in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-1 et. seq., the Regular Meetings of the Township Council of the Township of Vernon shall convene on the Second and Fourth Mondays of each Month (except as noted with * in schedule below) at 6:00 pm (if there is an Executive Session), or at 7:00 pm (if there is no Executive Session) at the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey for the following:

BE IT FURTHER RESOLVED, that if there is to be an Executive Session, the Township Council shall immediately convene into Executive Session after opening their Regular Meeting at 6:00 pm in order to discuss those matters in executive session from which the public shall be excluded and at 7:00 pm, or as soon thereafter, the public portion of the meeting will recommence.  Formal action may be taken at any Council Meeting.

BE IT RESOLVED that all Township Council meetings shall be open to the public and public participation will be entertained at all Township Council meetings.  There will be a limited period of public comment at the beginning of every meeting where speakers will be limited to three (3) minutes.  During the first period for public comment each speaker may speak only on items on the current agenda.  The total time for public speaking at the beginning of the meeting is limited to one half hour (30 minutes) to provide the Governing Body sufficient time to complete its work.

BE IT FURTHER RESOLVED that there will be a second period of public comment at the end of each Council meeting.  Speakers will be limited to five (5) minutes where the public may speak on any topic.

BE IT FURTHER RESOLVED that all Notices required by the Open Public Meetings Act shall be published in The New Jersey Herald/Sunday Herald and, if needed, in alternate newspapers, The Advertiser News, and The Star Ledger and shall be posted on the bulletin board in the Municipal Building.

RESOLUTION #23-03

A RESOLUTION TO APPOINT THE STANDARD INSURANCE COMPANY TO

PROVIDE A FULLY INSURED SHORT-TERM DISABILITY PROGRAM

FOR THE PERIOD 01.01.23 THROUGH 02.01.25

WHEREAS, the Township of Vernon (hereinafter, the Township) provides a Short-Term Disability (STD) benefit through a self-funded program for all full-time eligible employees in accordance with longstanding past practice; and

WHEREAS, the Township’s Health Benefits Consultant (HBC) was requested to review the Program, based upon the following:

    • The Township has maintained a Short-Term Disability (STD) Program for all municipal employees for over 20 years on a self-funded basis; whereby the Township both administered/adjudicated and also self-funded the cost of all STD claims.
    • Consequently, the Township has had to process these types of claims with frequency and apply coverage determinations in adjudicating claims filed by covered employees; and

WHEREAS, it was determined, prudence should be exercised to explore the market for an insurance solution that provides professional, consistent adjudication at a competitive cost; and

WHEREAS, the Standard Insurance Company (an “A” rated carrier specializing in disability programs on a fully insured basis) has been a proven carrier for the Township’s Group Life Program and consequently, the HBC solicited a Proposal for consideration; and

WHEREAS, the HBC has been able to successfully negotiate a STD Program, underwritten by The Standard Insurance Company that accomplishes the following:

  • Offers a Plan of Benefit that effectively matches the existing level of benefit.
  • Provides consistency in claims administration and adjudication, utilizing recognized and established industry protocols.
  • Offers Cost Savings to the Township based upon a review and analysis of the last two (2) years of claims activity.
  • Provides for implementation on January 1, 2023, thereby allowing for a consistency with the reset of sick/vacation time.
  • Provides budget stability with Standard offering a two (2) year (25 months) rate guarantee.
  • Will generate a 5% package discount on the Life Policy Renewal on February 1, 2023.

NOW, THEREFORE BE IT RESOLVED, by the Council of the Township of Vernon, County of Sussex, State of New Jersey, the Standard STD Proposal permitting an equal to or better benefit for all eligible Township employees, consistent with the current level of benefit is hereby accepted and directed to the Mayor and Township Administration for implementation; and

BE IT FURTHER RESOLVED, the Mayor, Township Administrative Team and Township Benefits Consultant are hereby authorized to take the appropriate steps necessary to effectuate the coverage for a January 1, 2023 effective date, or as soon thereafter as administratively practical and without interruption to those eligible employees; and

BE IT FURTHER RESOLVED, the contract award for these services is directly to a duly licensed and admitted Insurance Company within the State of NJ and therefore, such award is exempt from the requirements set forth by P.L. 2004, Chapter 19 (as amended by P.L. 2005, c.51) N.J.S.A.19:44A-20.5 et seq.; and

BE IT FURTHER RESOLVED,  a certified copy of this Resolution shall be forwarded to the Township CFO, Township Auditor and PIA Security Programs, 429 Hackensack Street, P.O. Box 818 Carlstadt, NJ, Health Benefits Consultant to the Township.

RESOLUTION #23-04

RESOLUTION TO ADOPT A CASH MANAGEMENT PLAN-2023

BE IT RESOLVED by the Township Council of the Township of Vernon, County of Sussex, that for the year 2023, the following shall serve as the cash management plan of the Township of Vernon.

1. Cash Management and Investment Objectives

The Township of Vernon has the following objectives.

A. Preservation of capital.

B. Adequate safekeeping of assets.

C. Maintenance of liquidity to meet operating needs.

D. Investment of assets in accordance with State and Federal Laws and regulations.

E. Maximize Yield.

2. Designation of Official Depositories

The following Government Unit Protection Act approved banks are authorized depositories for deposit of funds:

Lakeland Bank

Provident Bank

Valley National Bank

PNC Bank

JP Morgan Chase Bank

3. Cash Management

A. All funds shall be deposited within 48 hours of receipt in accordance with N.J.S.A.  40A:5-15

B. The Chief Financial Officer shall minimize the possibility of idle cash accumulating in accounts by assuring that any excess amounts not needed to cover expenses or in excess of negotiated compensating balances are kept in interest bearing accounts or promptly swept into the investment portfolio.

C. Investment decisions shall be guided by the cash flow projections prepared by the

4. Permissible Investments

A. Certificates of Deposits.

B. Savings and Loan Associations and Saving Bank Accounts.

C. New Jersey Cash Management Plan

D. Government Money Market Mutual Funds

E. Local Government Investment Pools, such as MBIA Municipal Investors Service Corporation CLASS

F. Short-Term Notes Issued to Local Governments and School Districts

G. Any other obligations with maturities not exceeding 397 days, as permitted by the Division of Investments.

5. Authority for Investment Management

The Chief Financial Officer is authorized and directed to make investments on behalf of the Township. All investment decisions shall be consistent with this plan and all appropriate regulatory constraints.

6. Reporting

The Chief Financial Officer shall report to the Township Council investments in accordance with N.J.S.A. 40A: 5-15.2.

7. Audit

The Cash Management Plan shall be subject to annual audit conducted pursuant to

N.J.S.A. 40A: 5-14.

8. Disposition of Abandoned Property

The Chief Financial Officer shall escheat to the State of New Jersey checks which remain outstanding for more than twelve months after the date of issuance.

Resolution #23-05

RESOLUTION AUTHORIZING THE EXECUTION OF

A SHARED SERVICE AGREEMENT WITH THE

VERNON TOWNSHIP MUNICIPAL UTILITES AUTHORITY FOR THE

PROVISION OF FINANCIAL/ADMINISTRATIVE SERVICES

WHEREAS, the Mayor and Council of the Township of Vernon Township, a Municipal Corporation of the State of New Jersey and the Vernon Township Municipal Utilities Authority (VTMUA), a municipal utilities authority established pursuant to N.J.S.A. 40:14-B-1 et. seq. have determined that a Shared Service Agreement for Financial /Administrative Services is in the best interest of the parties; and

WHEREAS, the VTMUA is willing to purchase by contract the financial/ administration support services being offered by the Township of Vernon for a three-year period at the following rates per year:

January 1, 2023 through December 31, 2023 $92,100.00

January 1. 2024 through December 31, 2024 $95,600.00

January 1, 2025 through December 31, 2025 $101,500.00

WHEREAS, the Agreement is authorized under N.J.S.A. 40A:65-1, et seq.

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Vernon, County of Sussex, and State of New Jersey, that the Mayor and Township Clerk are hereby authorized to execute a Shared Service Agreement between the Township and VTMUA for Financial/ Administrative Services in a form similar the agreement attached hereto.  Township Attorney may make applic able language changes deemed in the best interest of the Township.

BE IT FURTHER RESOLVED that this Resolution shall take effect immediately upon adoption according to law.

Resolution #23-06 

RESOLUTION AUTHORIZING THE EXECUTION OF

A SHARED SERVICE AGREEMENT WITH THE

VERNON TOWNSHIP MUNICIPAL UTILITES AUTHORITY FOR

THE SERVICES OF THE DEPARTMENT OF PUBLIC WORKS

WHEREAS, the Vernon Township Municipal Utilities Authority (“VTMUA”) is a municipal utilities authority established pursuant to N.J.S.A. 40:14B-1 et seq.; and

WHEREAS, the VTMUA has a need for public works services in connection with it maintaining the sewer assets in the Township of Vernon (“Township”); and

WHEREAS, it has been determined that the Township can provide public works services to the VTMUA without negatively impacting its operations and ability to serve the public; and

WHEREAS, the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1 et seq. provides the mechanism for local governments to enter into contracts for the joint provision of required services.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Vernon that the Mayor and Township Clerk are authorized to execute a Shared Service Agreement between the Township and VTMUA for the services of the Department of Public Works in a form similar the agreement attached hereto.  The Township Attorney may make applicable language changes deemed in the best interest of the Township.

BE IT FURTHER RESOLVED that this Resolution shall take effect immediately upon adoption according to law.

RESOLUTION #23-07

REAUTHORIZING PETTY CASH FUNDS FOR CALENDAR YEAR 2023

WHEREAS, N.J.S.A. 40A:5-21 authorizes the establishment of a Petty Cash

Fund in municipalities by application and resolution; and

WHEREAS, it is the desire of the Township of Vernon to establish the following Petty Cash Funds for calendar year 2023 as follows:

NOW, THERFORE BE IT RESOLVED that the Council of the Township of Vernon hereby authorizes such action and that the Township Clerk file two copies of this resolution with the Division of Local Government Services, State of New Jersey.

RESOLUTION #23-08

AUTHORIZING AN AGREEMENT WITH THE COUNTY OF SUSSEX, DEPARTMENT OF HUMAN SERVICES, DIVISION OF SOCIAL SERVICES, FOR TRANSPORTATION SERVICES FOR SENIOR CITIZENS AND PEOPLE WITH DISABILITIES WHO RESIDE IN VERNON TOWNSHIP FOR THE YEAR 2023 IN THE AMOUNT OF $50,000.00 PER YEAR

WHEREAS, the County of Sussex (hereinafter the County) operates a coordinated, countrywide transportation system and desires to improve paratransit service coverage to the outlying areas of its geographic boundaries; and

WHEREAS, the Township of Vernon (hereinafter the Township) desires transportation for its senior citizens and people with disabilities as per the service agreement; and

WHEREAS, the term of the agreement will be in effect beginning January 1, 2023 and terminating on December 31, 2023; and

WHEREAS, the cost of these services will not exceed $50,000.00 per year; and

WHEREAS, the Chief Financial Officer has certified the funds for 2023 subject to the adoption of the 2023 Municipal Budget.

NOW THEREFORE BE IT RESOLVED, the 1st day of January, 2023 by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows:

            1.         The Township of Vernon is authorized to engage the County of Sussex for the purpose of Transportation for Senior Citizens and People with Disabilities in accordance with the attached agreement; and

            2.         The Mayor and Township Clerk are hereby authorized and directed to execute an Agreement with the County of Sussex, State of New Jersey.

WHEREAS, the Township has a need for software use in the Planning & Zoning, Building, Administration, Fire Prevention and Assessor’s Offices for permitting, licensing, electronic maintenance of all inspection reports and transmission of monthly activity reports directly to the Department of Community Affairs; and

WHEREAS, for customer service efficiency and availability, Vernon Township has a need to utilize the Enterprise Licensing System offered by Spatial Data Logic, Somerset, NJ as a required disclosure contract pursuant to the provisions of N.J.S.A. 19:44A-20.4; for the calendar year of 2023 at a not to exceed cost of $23,800.00 for 14 user licenses.

WHEREAS, the Sean Canning, Q.P.A., has determined and certified in writing that the value of the acquisition will exceed $17,500; and,

WHEREAS, the anticipated term of this contract is for the year of 2023; and

WHEREAS, Spatial Data Logic in the aggregate is expected to provide more than the pay to play threshold of $17,500.00; and  

WHEREAS, Spatial Data Logic, has completed and submitted a Business Entity Disclosure Certification and a Personal Contribution Disclosure form which certifies that Spatial Data Logic has not made any reportable contributions to a political or candidate committee in the Township of Vernon in the previous one year, and that the contract will prohibit Spatial Data Logic from making any reportable contributions through the term of the contract, and

WHEREAS, the Chief Financial Officer hereby certifies that funds NOT TO EXCEED $23,800.00 are available as follows;

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Township of Vernon authorizes the Mayor to enter into a contract with Spatial Data Logic, not to exceed $23,800.00 for the 2023 budget year for Geologic Software for permitting and licensing purposes; and

BE IT FURTHER RESOLVED, that the Business Disclosure Entity Certification and Personal Contribution Disclosure form, Determination of Value be placed on file with this resolution.

AUTHORIZING CHANGE ORDER #1 OF CONTRACT FOR PROPOSED IMPROVEMENTS OF OLD COACH ROAD & PLEASANT VALLEY ROAD

WITHIN VERNON TOWNSHIP WITH GARDEN STATE HIGHWAY PRODUCTS, INC.

WHEREAS, on July 25, 2022, by way of adoption of Resolution #22-192, the Council of the Township of Vernon awarded a contract to Garden State Highway Products, Inc. for Traffic Sign Materials on Old Coach Road & Pleasant Valley Road which contract provided for an expenditure of $694.15; and

WHEREAS, in a memo dated December 14, 2022, the Township Engineer states that the contract requires a Change Order #1 of addition of two (2) supplemental items in amount of $530.44 and by the reduction of two (2) items in amount of $375.23; and

WHEREAS, the Township Engineer, in concurrence with the Mayor, recommends approving Change Order No. 1 resulting in the adjusted increased contract amount of $849.36.

NOW THEREFORE BE IT RESOLVED, by the Council of the Township of Vernon that it hereby approves the Township Engineer’s recommendations and authorizes the Mayor to execute said Change Order No. 1 for said project resulting in the adjusted decreased contract amount of $849.36 for said project; and

BE IT FURTHER RESOLVED that certified copies of this Resolution be forwarded to Garden State Highway Products, Inc. and the Township Engineer.

RESOLUTION #23-11

AUTHORIZING THE AWARD OF A CONTRACT FOR 2023 BETWEEN A & E CLOTHING AND THE TOWNSHIP OF VERNON TO LOCATE CLOTHING DONATION BINS AT MUNICIPAL RECYCLING CENTER

WHEREAS, Vernon Township has a need to contract with a vendor to locate Donation Clothing Bins in the Vernon Township Municipal Recycling Center on Church Street for the continued service to Township residents; and

WHEREAS, Vernon Township has received a proposal from A& E Clothing, Hamilton Township, NJ to provide Clothing Bins on Township Property and compensate Vernon Township $60.00 per month per Bin; and

WHEREAS, the Mayor and DPW Director recommends that Vernon Township renew a contract with A & E Clothing Corp to provide four (4) donation bins at the Recycling Center commencing January 1 through December 31, 2023; and

WHEREAS, A & E Clothing Corp. has been collecting clothing in New Jersey for over fourteen years which donations are shipped throughout the USA, Europe, Asia, Africa and South America and proceeds further support Non-Profit Organizations such as Retired Peace Officer Charity Organization and for research for Cancer, Crohn’s Disease and Sudden Infant Death Syndrome; and

NOW THEREFORE BE IT RESOLVED, by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows:

1.         The Township of Vernon is authorized to engage A & E Clothing Corp. for the purpose of locating four (4) Clothing Donation Bins at the Vernon Township Municipal Recycling Center, Church Street, NJ, for compensation of $60.00 per month per bin to the Township

2.         The Mayor and Township Clerk are hereby authorized and directed to execute Contract with A & E Clothing Corporation Corp.

RESOLUTION #23-12

AUTHORIZING THE AWARD OF CONTRACT FOR Professional Services FOR Qualified purchasing agent

WHEREAS, there is a need for a Qualified Purchasing Agent for the year 2023 for the Township of Vernon; and

WHEREAS, N.J.S.A. 40A:11-5 specifically exempts professional services from provisions of public bidding as provided in the Local Public Contracts Law; and

WHEREAS, said specified professional services are to be rendered or performed by a person or persons authorized by law to practice a recognized profession, and whose practice is regulated by law within the meaning of N.J.S.A. 40A:11-1 et seq., as amended; and

WHEREAS, the performance of said professional services requires knowledge of an advanced field of learning acquired by a prolonged formal course of specialized training and study as distinguished from general academic instruction or apprenticeship and training; and

WHEREAS, the Township of Vernon is desirous to appoint Sean Canning, MPA, QPA of The Canning Group, LLC, as a non-fair and open contract pursuant to the provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.; and

WHEREAS, the Chief Finance Officer has determined and certified in writing that the value of the contract is available for these purposes subject to the adoption of the 2023 Municipal Budget; and

WHEREAS, the Local Public Contracts Law N.J.S.A. 40A:11-1 et seq., as amended, requires that this Resolution be publicly advertised.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Vernon that Vernon Township hereby authorizes and approves the award of contract of a Professional Service Contract to Sean Canning, MPA, QPA from The Canning Group, LLC pursuant to a non-fair and open contract pursuant to the provisions of the Local Public Contracts Law, N.J.S.A. 40A:20-1 et seq. to provide Legal Services in accordance with the attached Contract for Professional Services.

BE IT FURTHER RESOLVED, that the award of contract shall be contingent upon the completion and receipt of the following:

  1. A fully-executed professional services contract detailing the scope of services, established fees for said professional services, mandatory Equal Opportunity Language and Affirmative Action Certificate; and
  2. New Jersey Business Registration Certificate; and
  3. Upon the aforementioned professional being a member in good standing in his respective profession.

BE IT FURTHER RESOLVED, that the Mayor and Township Clerk are hereby authorized and directed to execute, seal and deliver the attached Contracts for Professional Services on behalf of and in the name of the Township of Vernon and that the Township Clerk shall publish the award of contract as required by law within ten (10) days of passage of this Resolution.

RESOLUTION APPOINTING RISK MANAGEMENT CONSULTANT

WHEREAS, the Township of Vernon (hereinafter “Local Unit”) has joined the Statewide Insurance Fund (hereinafter “Fund”), a joint insurance fund as defined in N.J.S.A. 40A:10-36 et seq.; and

WHEREAS, the Bylaws require participating members to appoint a Risk Management Consultant, as those positions are defined in the Bylaws, if requested to do so by the “Fund”; and

WHEREAS, the Local Unit has complied with relevant law with regard to the appointment of a Risk Management Consultant; and

WHEREAS, the “Fund” has requested its members to appoint individuals or entities to that position.

WHEREAS, on July 25, 2022, by way of adoption of Resolution #22-191, the Council of the Township of Vernon awarded a contract to Denville Line Painting, Inc. for Line Striping on Various Streets specifically Karen Road, Beaver Brook Road, Paddock Avenue and Lounsberry Hollow Road which contract provided for an expenditure of $8,686.64; and

WHEREAS, in a memo dated December 12, 2022, the Township Engineer states that the contract requires a Change Order #1 by the reduction of one item in amount of $57.46, and addition of one extra item in the amount of $21.76; and

WHEREAS, the Township Engineer, in concurrence with the Mayor, recommends approving Change Order No. 1 resulting in the adjusted decreased contract amount of $8,650.94.

NOW THEREFORE BE IT RESOLVED, by the Council of the Township of Vernon that it hereby approves the Township Engineer’s recommendations and authorizes the Mayor to execute said Change Order No. 1 for said project resulting in the adjusted decreased contract amount of $8,650.94 for said project; and

AUTHORIZING A CONTRACT WITH MUNIDEX TO MAINTAIN THE TOWNSHIP’S VITAL STATISTIC SOFTWARE FOR 2023

WHEREAS, the Township of Vernon has a need to maintain its vital statistic software; and

WHEREAS, MUNIDEX, Inc. supplied the original vital statistic software to the Township and has the expertise to maintain said program; and

WHEREAS, the Chief Financial Officer recommends that the Township Council award a contract to maintain the Township’s vital statistic software to Munidex, Inc., 174 Route 17 North, Rochelle Park, NJ 07662; and

WHEREAS, the cost for this annual maintenance contract is $684.00 and there may be additional charges if on-site maintenance service is required and the Chief Financial Officer of the Township of Vernon, has certified these funds are available in account #3-01-20-120-20.

NOW THEREFORE BE IT RESOLVED, by the Township Council of the Township of Vernon, that the Mayor and Municipal Clerk are authorized to sign and accept the Software Maintenance Agreement for the year 2023 to maintain the Township’s vital statistic software in an amount of $684.00; and

RESOLUTION OF THE TOWNSHIP COUNCIL OF THE

TOWNSHIP OF VERNON, COUNTY OF SUSSEX,

AND STATE OF NEW JERSEY APPOINTING

DEPUTY CUSTODIANS OF RECORDS

WHEREAS, the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq. (“OPRA”), names the municipal clerk as the custodian of government records; and

WHEREAS, certain officials and/or departments receive numerous public records requests based upon the nature of their official duties and/or office; and

WHEREAS, the governing body may designate one or more deputy custodians to facilitate compliance with OPRA; and

WHEREAS, the governing body adopted the policy of Deputy Custodians of Records via Resolution 16-175 on July 25, 2016 and wishes to continue this practice; and

WHEREAS, the Township Council of the Township of Vernon has determined that it is in the best interest of the Township and the public to designate deputy custodians for specific officials and/or departments.

NOW THEREFORE IT BE RESOLVED by the Township Council of the Township of Vernon, County of Sussex, and State of New Jersey, as follows:

  1. The Police Chief is hereby appointed as the deputy custodian of records for Police Department records.
  2. The Tax Collector is hereby appointed deputy custodian of records for tax collection records.

WHEREAS, N.J.S.A. 40:53-1 et al. of the Open Public Meetings Act requires that the governing body of every municipality designate an official newspaper or newspapers for the publication of all advertisements and notices required by law to the published by the municipality; and

WHEREAS, the second newspaper designated by this body must be one which has the greatest likelihood of informing the public within the jurisdictional boundaries of this body of such meetings; and

WHEREAS, The New Jersey Herald/Sunday Herald is hereby designated to receive all notices of meetings as required under the Open Public Meetings Act and The Star Ledger, and the Advertiser News and will be designated as the alternate newspapers; and

WHEREAS, it is the opinion of this public body that The New Jersey Herald/Sunday Herald, have the greatest likelihood of informing the public within the jurisdictional area of this public body of such meetings.

APPOINTMENT OF PUBLIC AGENCY COMPLIANCE OFFICER

WHEREAS pursuant to the provisions of N.J.A.C. 17:27-1 the Township of Vernon is required to designate a Public Agency Compliance Officer on an annual basis; and

WHEREAS said Public Agency Compliance Officer shall act as the official liaison for all equal opportunity employment matters in the administration of public contracts; and

WHEREAS the Township designates the Township Acting Co-Business Administrator, Donelle Bright as the Public Agency Compliance Officer for calendar year 2023;

WHEREAS, every municipality is required to designate an ADA Coordinator; and

WHEREAS, the ADA Coordinator’s role is to ensure the Township’s compliance with the Americans with Disabilities Act.

WHEREAS, upon authorization, Signature Information Solutions, agrees to use this information for the sole purpose of providing tax search information to the title industry; and

WHEREAS, Signature Information Solutions also agrees to protect the information obtained and to not re-sell or re-distribute this same information or make available to a third party except as needed for the purpose of providing information for tax searches to the title industry.

NOW THEREFORE BE IT RESOLVED by the Council of the Township of Vernon:

WHEREAS, upon authorization, Valtech Research, agrees to use this information for the sole purpose of providing tax search information to the title industry; and

WHEREAS, Valtech Research also agrees to protect the information obtained and to not re-sell or re-distribute this same information or make available to a third party except as needed for the purpose of providing information for tax searches to the title industry.

NOW THEREFORE BE IT RESOLVED by the Council of the Township of Vernon:

      1. Vernon Township will authorize Edmunds and Associates to provide look up information access to Valtech Research for Vernon Township property tax and/or utility records.

WHEREAS, the Township of Vernon received a request from Action Title Research seeking electronic “look only” inquiry access to the public tax records administered by the tax collector; and

WHEREAS, Vernon Township’s tax records are currently maintained in an electronic format by Edmunds and Associates of Northfield, New Jersey; and

WHEREAS, upon authorization, Action Title Research, agrees to use this information for the sole purpose of providing tax search information to the title industry; and

WHEREAS, Action Title Research also agrees to protect the information obtained and to not re-sell or re-distribute this same information or make available to a third party except as needed for the purpose of providing information for tax searches to the title industry.

NOW THEREFORE BE IT RESOLVED by the Council of the Township of Vernon:

      1. Vernon Township will authorize Edmunds and Associates to provide look up information access to Action Title Research, for Vernon Township property tax and/or utility records.

      2. Action Title Research shall be subject to Edmunds and Associates policies and procedures.

      3. Action Title Research waives any claim that it may have against Vernon Township in connection with Edmunds and Associates policies and procedures.

4. WHEREAS, upon authorization, Priority Search Services, LLC, agrees to use this information for the sole purpose of providing tax search information to the title industry; and

WHEREAS, Priority Search Services, LLC also agrees to protect the information obtained and to not re-sell or re-distribute this same information or make available to a third party except as needed for the purpose of providing information for tax searches to the title industry.

NOW THEREFORE BE IT RESOLVED by the Council of the Township of Vernon:

      1. Vernon Township will authorize Edmunds and Associates to provide look up information access to Priority Search Services, LLC, for Vernon Township property tax and/or utility records.

      2. Priority Search Services, LLC shall be subject to Edmunds and Associates policies and procedures.

Resolution #23-29

RESOLUTION OF THE TOWNSHIP OF VERNON APPOINTING A MUNICIPAL PUBLIC DEFENDER

WHEREAS, the Township of Vernon (”Township”) has a need for a Municipal Public Defender; and

WHEREAS, pursuant to N.J.S.A. 2B:24-3, a municipality may employ an attorney-at-law as the Municipal Public Defender; and

WHEREAS, John C. Grey, Jr, Esq has the necessary experience and qualifications to perform the duties of Municipal Public Defender; and

WHEREAS, N.J.S.A. 40A:11-5 specifically exempts professional services from provision of public bidding as provided in the Local Public Contracts Law; and

WHEREAS, the Township deems it in the best interests of the Township to appoint John C. Grey, Jr., Esq. as the Municipal Public Defender and to enter a non-fair and open contract to provide said services pursuant to the provisions of the Local Public Contract Law, N.J.S.A. 40A:11-1 et seq.; and

WHEREAS, John C. Grey, Jr., Esq. will complete and submit a Business Entity Disclosure Certification for Non-Fair and Open Contract which certifies that John C. Grey, Jr., Esq. has not made any reportable contributions to a political or candidate committee in the Township of Vernon in the previous one year and that the contract will prohibit John C. Grey, Jr., Esq. from making any reportable contributions through the term of the contract to a political or candidate committee in the Township of Vernon; and

WHEREAS, the Chief Financial Officer has certified that there are sufficient funds available.

NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Vernon as follows:

  1. John C. Grey, Jr., Esq. is hereby appointed as Municipal Public Defender for one (1) year from January 1, 2023 to December 31, 2023 and the Mayor is authorized to execute a non-fair and open contract with John C. Grey, Jr., Esq. to provide these services.
  1. The required Business Entity Disclosure Certification and Political Contribution Disclosure Form shall be provided before execution of the contract and be placed on file with the resolution

RESOLUTION OF THE TOWNSHIP OF VERNON APPOINTING A MUNICIPAL PROSECUTOR

WHEREAS, the Township of Vernon (” Township”) has a need for a Municipal Prosecutor; and

WHEREAS, pursuant to N.J.S.A. 2B:12-27, a municipality may employ an attorney-at-law as the Municipal Prosecutor under the supervision of the County Prosecutor and that attorney may represent the municipality in any matter within the jurisdiction of the central municipal court and any other municipal court; and

WHEREAS, Alicia Ferrante, Esq. has the necessary experience and qualifications to perform the duties of Municipal Prosecutor; and

WHEREAS, N.J.S.A. 40A:11-5 specifically exempts professional services from provision of public bidding as provided in the Local Public Contracts Law; and

WHEREAS, the Township deems it in the best interests of the Township to appoint _Alicia Ferrante, Esq. as the Municipal Prosecutor and to enter a non-fair and open contract to provide said services pursuant to the provisions of the Local Public Contract Law, N.J.S.A. 40A:11-1 et seq.; and

RESOLUTION #23-31

Authorizing The Award of Contract

For Professional Services

WHEREAS, there is a need for Professional Services to the Township of Vernon for Attorneys, Auditor, Bond Counsel, Prosecutor, Public Defender, Engineer, Planner, Financial Advisor and Appraisal services and;

WHEREAS, N.J.S.A. 40A:11-5 specifically exempts professional services from provisions of public bidding as provided in the Local Public Contracts Law; and

WHEREAS, said specified professional services are to be rendered or performed by a person or persons authorized by law to practice a recognized profession, and whose practice is regulated by law within the meaning of N.J.S.A. 40A:11-1 et seq., as amended; and

WHEREAS, the performance of said professional services requires knowledge of an advanced field of learning acquired by a prolonged formal course of specialized training and study as distinguished from general academic instruction or apprenticeship and training; and

WHEREAS, the Township of Vernon is desirous to enter into an agreement with these professionals as a fair and open contract pursuant to the provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., as amended; and

WHEREAS, the Chief Finance Officer has certified in writing that the value of the contracts are available for these purposes subject to the adoption of the 2023 Municipal Budget; and

WHEREAS, the Local Public Contracts Law N.J.S.A. 40A:11-1 et seq., as amended, requires that this Resolution be publicly advertised.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Vernon that they hereby authorize and approve the award of contracts of a Professional Service Contract pursuant to the provisions of the Local Public Contracts Law, N.J.S.A. 40A:20-1 et seq. to provide Services in accordance with the attached Contracts for Professional Services pursuant to a non-fair and open contract to the following:

Language and Affirmative Action Certificate; and

  • Receipt of all statutorily mandated “pay to play” political contribution forms

pursuant to N.J.S.A. 19:44A-20.4 et seq.; and

  • New Jersey Business Registration Certificate; and
  • Upon the aforementioned professional being a member in good standing in his respective profession.

BE IT FURTHER RESOLVED, that the Mayor and Municipal Clerk are hereby authorized and directed to execute, seal and deliver the attached Contracts for Professional Services on behalf of and in the name of the Township of Vernon and that the Municipal Clerk shall publish the award of contract as required by law with ten (10) days of passage of this Resolution.

RESOLUTION #23-32

ESTABLISHING INTEREST RATES

FOR DELINQUENT PROPERTY TAXES AND ASSESSMENTS

WHEREAS, N.J.S.A. 54:4-67 permits the governing body of each municipality to fix the rate of interest to be charged for nonpayment of taxes or assessments subject to any abatement or discount for the late payment of taxes as provided by law; and

WHEREAS, N.J.S.A. 54:4-67 has been amended to provide an additional penalty of up to six percent (6%) on delinquent taxes and all municipal charges in excess of $10,000.00 that are not paid prior to the end of the fiscal year; and

WHEREAS, this resolution is necessary for efficient and uninterrupted operations of the business of the Tax Collector.

NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of Vernon that:

1.   The Tax Collector of Vernon Township is authorized to cancel all payments of taxes of $10.00 or less.

2.   That no interest shall be charged if payment of any installment is made within ten (10) days after date upon which the same became payable.

3.   That the rate of interest to be charged for nonpayment of taxes on or before they would become delinquent shall be 8% per annum on the first $1,500.00 of the delinquency and 18% per annum, on any amount in excess of $1,500.00, and;

4.   Interest at the rate of 8% per annum on the unpaid balance of assessment is charged with each installment on due date.  Any installment not paid on or before due date is subject to 8% interest, 18% interest over $1,500.00.

5.   A Year End Penalty of 6% is hereby assessed on delinquent tax accounts in excess of the sum of $10,000.00 if a taxpayer shall fail to make payment in full on the delinquent amount prior to the end of the calendar year in which such taxes shall have accrued and been assessed.          

6.   That the Chief Financial Officer of the Township of Vernon is hereby authorized to make investments for the Township of Vernon.

Resolution #23-33

Adoption of 2023 Temporary Municipal Budget

WHEREAS, The Local Budget Law, N.J.S.A. 40A:4-1 et seq., provides that until the official Annual Budget for the budget year is adopted, a temporary budget not exceeding 26.25% of the total of all appropriations including appropriations for debt service, capital improvement fund, and public assistance must be adopted covering the first quarter of the fiscal year; and

WHEREAS, N.J.S.A. 40A:4-1 et seq. further provides that the governing body of a municipality must adopt by resolution within the first thirty (30) days of the budget, by affirmative vote of the full membership of the governing body, a temporary budget; and

WHEREAS, the Township Council desires to establish temporary appropriations pursuant to the Local Budget Law; and

WHEREAS, total appropriations for the 2022 Annual Budget, exclusive of any appropriations for debt service, capital improvements, and public assistance was $26,064,808.10; and

WHEREAS, up to 26.25% of total appropriations for the 2023 Annual Budget, exclusive of any appropriations for debt service, capital improvements, and public assistance is $5,679,601.67 for a total of $8,332,851.67;

NOW, THEREFORE BE IT RESOLVED by the Council of the Township of Vernon that the attached Schedule ‘A’ entitled “2023 Temporary Budget” is hereby approved.

RESOLUTION #23-34

RESOLUTION OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF VERNON AUTHORIZING THE AWARD OF PAYROLL MANAGEMENT SERVICES AND SOFTWARE VENDOR THROUGH THE COMPETITIVE CONTRACTING PROCESS CC# 4-2019

WHEREAS, the Township of Vernon has a desire to provide for provide for payroll management services and software offerings for the operation of its financial matters in accord with the New Jersey Local Fiscal Affairs Law; and

WHEREAS, such services are currently available to be provided through the competitive contracting process under the New Jersey Local Publics Contract Law, N.J.S.A. 40A:11-4.1, and for a period of five (5) years under N.J.S.A 40A:11-4.1 et. Seq., and

WHEREAS, the Township received Competitive Contract proposals, CC# 4-2019 on May 21, 2019 at 11:00 A.M.; and

WHEREAS, the Township authorized the competitive contract process though council approved resolution, in accord with the prescripts of N.J.S.A.40A:11-4.1 through resolution #19-95; and

WHEREAS, the Township established a rating committee rating the proposals upon the standards of price and other factors, those factors being Technical, Managerial and Cost factors in accord with N.J.A.C.5:34-4; and

WHEREAS, Action Data Services Inc., 17 Sherwood Lane, Fairfield, N.J. 07004, has provided a proposal deemed responsive and responsible under the New Jersey Local Publics Contract Law (N.J.S.A.40A:11-1 et. Seq.,); and

WHEREAS, the report produced by the committee, recommending Action Data Services Inc, was made available to the public and governing body at least 48 hours prior to the meeting of the governing body in accord with N.J.S.A 40A:11-4.1 and N.J.A.C 5:34-4; and

WHEREAS, subject to the yearly extension of contract for a maximum of five (5) years, the governing body approval of the 2023 budget the amount of contract is not to exceed:

These appointments are to fill the positions that come available annually on our town’s outstanding MUNICIPAL BEAUTIFICATION COMMITTEE. This is a committee that has received lots of praise, thanks, and other glowing words of appreciation from all segments of our town, as well as from those who live in other towns, but travel through Vernon during their daily commutes. For years, this Committee’s beautiful plantings in the summer, spring and fall, and their outstanding holiday decorations in the winter, have lifted our spirits, and caused our hearts to smile with pride at how good and welcoming our town looks as a result of their work. So it is with pleasure that I bring this team back again for another 1-year term. I hereby reappoint the individual who has led this Committee so successfully during my three years as Mayor, Ms. MARY ELLEN VICHICONTI. I also reappoint the other creative team members who have worked diligently, side-by-side with her - - I speak of Ms. STEPHANIE SCILLINGO, Ms. REBA BURRELL, and Ms. KAREN GONEN. Thank you team!  Your value to our town is measured not only in the positive comments that I and members of the Council often receive, but also in the smiles that fill the faces, and the pride that fills the hearts, of our town’s residents. 

This well-functioning Committee is made up of members of the Vernon Township family who have withstood the slings and arrows of time, and have earned the right to wear the honorable title of “Senior Citizen”. Ms. Jane Damstra, the Director of our Municipal Senior Center, tells me that this Committee has played a critical role in the success of the many programs and activities that our town offers the members of our municipal senior family. So, it is without a shadow of a doubt that I reappoint Ms. GLORIA FRATO, MS. CHRISTA GERRY, MS. NANCY GULDEN, MS. JOSEPHINE PRISCO, MS. SUSAN PUSZTAY, Mr. LAYTON BERGMAN, and MS. MARILYN YURANSKY to new 3-year terms as members of the MUNICIPAL SENIOR CITIZEN COMMITTEE.  

This year brings two openings on the Environmental Commission. These openings are for 3-year terms. To fill one of those openings, I reappoint Commissioner CATARINI SAWOSZCZYX to another term. To fill the other opening, it is my pleasure to appoint Ms. JENNIFER CARLSON to be our newest Environmental Commissioner. Ms. CARLSON, a 26-year resident of our town, has been active in promoting positive environmental causes for years. She has played key roles in organizing events such as Earth Day celebrations and Cut-A-Thons, where funds are raised to promote and benefit Arbor Day.

Ms. CARLSON’s experience at promoting marketing events with Straus News, The Times Herald Record Newspaper, and the Spectrum Cable Company gives her the added potential to be of significant value to our ENVIRONMENTAL COMMISSION in promoting its causes and events.

The MUNICIPAL LAND USE BOARD is a Statuary Board that’s created by NJ Land Use Law, and is one of the most important and influential boards in any municipality. This year brought six openings on this Board; five of which I as Mayor have the responsibility for appointing, and one - - that being the Board member who represents the Council - - is the Council’s responsibility to appoint. Because they have served this Board, and the people of Vernon, so well during their terms, I am pleased to reappoint the following individuals to new terms on the MUNICIPAL LAND USE BOARD:

1. Mr. JOHN AUBERGER - - I am honored that this former Council Member has agreed to serve as my representative on this Board for another year.

2. Mr. CRAIG WILLIAMS - - Because his extensive knowledge and experience are key assets to this Board, it is with confidence that I reappoint him to serve a new 3-year term as the Class II representative on this Board.

3. Mr. MICHAEL WHITAKER - - His seven years of service on this Board has been a strength for the Board; and, because I don’t want to take this strength away, I hereby reappoint him to a new Class IV, 3-year term on this Board. 

4.  Mr. PAUL MELE - - He has requested an opportunity to continue his serve on this Board, and I have chosen to give him that opportunity by reappoint him to serve in a 2-year Alternate # 2 position on this Board.

As I said earlier, the MUNICIPAL LAND USE BOARD is one of the most important and influential boards in any municipality. This Board is responsible for the Municipality’s Master Plan, and controls the development and use of land within the Municipality in accordance with the Municipality’s Master Plan. This includes the selection of land for recreation, open space, and residential and business development. A board with this kind of diverse Statuary responsibility needs members with a diversity of skills and experiences; and therefore, I am delighted to have the opportunity to appoint Mr. MARK HEFTLER, Esq. to serve a 2-year Alternate # 2 position on this Board. Mr. HEFTLER brings to this Board his diverse educational background of a BA in English Literature, a Master’s Degree in Business Administration, and a Law Degree from the Seaton Hall Law School. He also has an extensive background of volunteer leadership and civic service. His diverse background and experiences can only help this Board maintain its current high quality.  

All of the seats on the MUNICIPAL ECONOMIC DEVELOPMENT ADVISORY COMMITTEE are for a 1-year terms; and therefore, all seats are available for appointment this year. Two of last year’s members on this Committee have requested to be reappointed to serve another year, and I gladly grant their request. The first is former Council Member and former Mayor, Ms. SALLY RINKER; and, the second is an individual who is an active volunteer in activities that support both, the Vernon schools and the Vernon community in general, Ms. KEREN GONEN. 

Anyone with the knowledge of our town’s decades’ long efforts to develop a Town Center, and to develop and add other amenities, that will attract the type of commercial ventures which will:

1. Provide additional needed tax dollars that will help to reduce the municipal tax burden on our homeowners; and …

2.  Provide residents the additional services and conveniences that they need and want - -

Anyone with the knowledge of our town’s decades long efforts in this regard know that we should take advantage of every opportunity that we have to bring in new, fresh thinking and diversity of ideas. Four Volunteer Applications have presented me with just such an opportunity. I have chosen to act on this opportunity by appointing the following four individuals as new members to the MUNICIPAL ECONOMIC DEVELOPMENT ADVISORY COMMITTEE:

1. Mr. MICHAEL GELFAND - - In addition to his educational background of a BA Degree from Syracuse University, and a Master’s Degree from NYU, he will bring to this Committee his experience as a Director with the Professional Services firm and Big Four Accounting Organization KPMG, plus his unique knowledge of our community gained in part from his 12 years of service on the Board of the Highland Lakes Country Club.

2. Ms. SUSAN BERKLAY - - She will bring to this Committee some new, fresh thinking and a diversity of ideas that will come from her BA Degree in American Studies from Columbia University, and her 29 years of pharmaceutical marketing experience.

3. Ms. Mary Beth Ziba - - She will bring to this Committee not only the educational experience gained from her Political Science Degree from Duke University, but also the experience and ideas that she has gained from her 10 years of work in Business Administration; her 3 years as a Small Business Owner; and her 35 years of working in the Hospitality Industry.

4. Mr. CARL CONTINO - - His Technical School’s Specialization in Architectural Technology & Design, his BA Degree in History, plus his years of working in the Vernon community will be valuable additions to what I hope will be a rejuvenated MUNICIPAL ECONOMIC DEVELOPMENT ADVISORY COMMITTEE. 

One vacancy exists on our MUNICIPAL BOARD of RECREATION, a Board that has proven itself to be very effective in planning, organizing, directing, and coordinating well organized recreational activities for Vernon family members of all ages. From what I have learned from attending meetings and seminars at the League of Municipalities Conventions, and from talking to mayors of other  municipalities in Sussex County, as well as mayors in other parts of our state, Vernon is somewhat unusual and unique from the standpoint of our heavy reliance on a combination of a volunteer MUNICIPAL BOARD of RECREATION, working close with our PAL organization, to provide a very large range of successful municipal recreation activities, events, and other quality of life services for our town’s residents. The value and importance to our residents of these recreation activities, events, and other provided quality of life services is evidenced by the large and growing number of residents who participate in, who attend and who express their enjoyment and appreciation of these community programs and activities. The financial benefit of providing these community programs and activities through a combination of our volunteer MUNICIPAL BOARD of RECREATION and our PAL organization can be measured in the savings of municipal tax dollars, when compared to what other towns spend on comparable community programs and activities. Ms. HEATHER LaBANCE’s dedicated and active participation on this Board have been critical to its success; and, I am very pleased that she responded affirmatively to my request that she continue to serve our community as a volunteer. Therefore, it is with a great degree of satisfaction that I reappoint her to a new 3-year term on the MUNICIPAL BOARD of RECREATION.

First, I want to thank former Council President Rizzuto for his leadership of the Council during the 2022 calendar year. While he and I have not always agreed on every issue, I have a first-hand understanding of the fact, that while being in a leadership role is for sure a privilege and an honor, I also know and understand that it is never the simplest, or always the easiest or most comfortable role in which to be. He has been a fighter and a fierce promoter in support of the positions and issues that he has advocated for, and for that, he has my respect. Again, thank you Council Member Rizzuto for your leadership. 

Second, I want to congratulate and welcome Council Member Lynch as the new Council President. I have known Brian for several years, and during the time that I served jointly as a Sussex County Commissioner and a member of the Vernon Town Council, it was at his invitation that I joined with him and a team of Highland Lakes Fire Department members in a burning building simulator training session. That was literally a scary “baptism by fire” experience for me. But it was also a bonding experience between me and Brian and the other fire fighters. What I know of Brian, he is a direct, no nonsense, tell-it-like-it-is, sometimes blunt, but good and fair person; and it is for those and other reasons, that I look forward to working with him as the leader of this year’s Council.

Yesterday, we said goodbye to the old year; and today, we welcome in the new year. For generations, this has been a hopeful time for people all over the world. It’s a time when there is hope that bad things can be made good; that hurtful wounds that were opened, can be healed; that problems which were viewed from the darkness of confusion, can be seen in a clearer light; and where relationships that were painfully strained, can be gingerly mended. I am among those who view this time with hope, because being hopeful is part of my American heritage; because being hopeful is part of my personal upbringing; and because being hopeful has worked so well for me throughout my life, it is the only way that I know how to live. Please don’t confuse my hopefulness with naiveness or weakness, as some have mistakenly done. My hopefulness is not naiveness, because my life experiences have clearly taught me that while we live in a world of much goodness, we will also encounter those individuals, and those events and days, that will make some aspects of our lives so miserable, so uncomfortable, so hard, and so hurtful, until we will sometimes feel as if it’s an uphill climb just to get to the bottom. But my faith and life experiences have also taught me that if we just endure; if just don’t give up; if we just fight on through the dark nights; that hopeful strength that we need will return in the morning. And my hopefulness is not weakness, because my life experiences have clearly taught me that being strong does not mean that you never get hurt, it simply means that when you do get hurt, you never let the hurt defeat you.

And so, as I enter this last year of having the honor and privilege of serving as your Mayor, I do so knowing and understanding that the Council and I will face some difficult economic and other challenges; but believing that together, we can be successful in our ongoing efforts to make Vernon and even better town in which to live and raise a family. I am ready and eager to meet those challenges; so, let us begin!

COUNCIL COMMENTS

Council Member Rizzuto had no other comments

Council Member Sparta wished everyone a healthy and safe new year looking ahead. He looks forward to a year of good discussion with the Council and the Mayor as well as bridges being mended and new ones being built. Council Member Sparta feels that we should have a very productive year with the Council, Mayor and Administration.

Council Member Tadrick feels that Council Member Rizzuto has been a strong leader and a very good friend and he supports him 100%. Council Member Tadrick thanked the Council for welcoming him as the new guy and letting him ask some hard questioned. He hopes that 2023 is going to be a better year. He wished everyone a happy and safe new year.

Council Vice President Buccieri feels that it is an honor to start our meeting with all of the volunteers on such a positive note and to see how many people devote themselves to our community. She thanked the Council for supporting her in her second year as Council President and she is proud to serve in that capacity. Vice President Buccieri congratulated Council President Lynch as she looks forward to working with him. She also thanked Pat Rizzuto for his leadership and selfless dedication. She is optimistic about our town and any challenges that may come before the Council and hopes we can build on what was started in 2022. Vice President Buccieri is looking forward to working on the budget and providing the great services that are provided by the town workers. She also hopes to keep the tax burden as manageable as possible and welcoming potential commercial and residential interest. She wished everyone a happy new year and hopes that 2023 will be a great year.

Council Member Tadrick told the Vietnam Veterans that they always have a home in Vernon.

COUNCIL PRESIDENT COMMENTS

Council President Lynch thanked everyone for coming to join us at the reorganization meeting. He explained that he was voted on to the Council for reasons that were not able to be taken care of due to the fact of time constraints. He said that we have a pump track that he hopes everyone uses safely. Council President Lynch said that Emil Izzo from Highland Lakes passed away this week and he was a Charter Member of the Highland Lakes Fire Department.

Council President Lynch explained that this Council does not have an agenda aside from anyone else. We are all here to do the good work of Vernon Township. He wished everyone a happy and health 2023.

ADJOURNMENT

At 1:07 pm Council Member Buccieri made a motion to adjourn the Reorganization meeting. Seconded by Council Member Tadrick.
