The meeting of the Township Council of the Township of Vernon was convened at 7:30 p.m. on Thursday, February 16, 2017 in the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey with Council President Jean Murphy presiding.

Statement of Compliance

Adequate notice of this meeting has been provided to the public and the press on January 5, 2017 and February 7, 2017, and was posted on the bulletin board in the Municipal Building in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-7.

WHEREAS, the Vernon Township Municipal Utilities Authority (“VTMUA”) is a duly established utilities authority pursuant to the Municipal and County Utilities Authorities Law, N.J.S.A. 40:14B-1, et seq.; and

WHEREAS, the VTMUA has multiple vacancies in its membership that need to be filled.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE TOWNSHIP OF VERNON, COUNTY OF SUSSEX, and STATE OF NEW JERSEY, that the following individual is hereby appointed as a member of the Vernon Township Municipal Utility Authority, effective 2/16/2017, for an unexpired term specified as follows:

Proclamations

Black History Month

Council President Murphy read a Proclamation for Black History Month

WHEREAS, Black History Month affords special opportunity to become more knowledgeable about black heritage, and to hone the many black leaders who have contributed to the progress of our nation;

WHEREAS, such knowledge can strengthen the insight of all our citizens regarding the issues of human rights, the great strides that have been made in the crusade to eliminate the barriers of equality for minority groups, and the continuing struggle against racial discrimination and poverty;

NOW THEREFORE BE IT RESOLVED, by the Township Council of the Township of Vernon that FEBRUARY 2017 shall be proclaimed BLACK HISTORY MONTH in the Township of Vernon and urge our residents to join together in making this period of rededication to the principles of justice and equality for all people.

Sally Rinker, Vernon, opined that regarding Ordinance 17-02, the sale of Faline Building, that the Mayor & Council have obligation to taxpayers to make bona fide effort to obtain the best price for the asset by a certified appraiser. Ms. Rinker added commercial property takes longer to market and sell since it appeals to a smaller market. She added that the Mayor and Council have labeled property as blight, undesirable and low value which may hurt potential sale price. Ms. Rinker stated since the property is assessed at $320,000, any new improvements will only raise the assessment, causing buyer with doubts which is why new appraisal should be done.

Council Member Ooms added that the 90-day window in Ordinance is too short for improvements to be completed and should be lengthened.

Jeanne Buffalino, Vernon Police Athletic League, expressed that the current Recreation employee, Mishelle Downtain, is hard working, dependable, and serves the public well and opined that she is not valued as she should be. She added that when new residents move to town, they look at schools, recreation and activities for children which Ms. Downtain works closely with Vernon non-profits to achieve the best results. Since Ms. Downtain has been in this position, the Recreation Department and volunteer Committee have been revived and very active serving our residents well and stressed to the Council to consider her value.

Denise Urbaniak, a volunteer with the Recreation Board, who has worked with the past two directors, feels Mishelle Downtain has been doing an exceptional job filling the position as Director. She has brought new ideas to our Township, is great working with the youth sports groups and promotes cooperation among all and added that Ms. Downtain gives back tremendously to our community.

Seeing no more members of the public wishing to come forward, Council President Murphy asked for a motion to close public comments.

Mayor’s Report

Mayor Shortway announced that on Saturday February 25, 2017, the ribbon cutting for the new satellite office for Congressman Josh Gottheimer will be held at the Vernon Municipal Building. Mayor Shortway noted that the NJDEP who funds actions for Sustainable Jersey has accepted Vernon’s Greenway Action Advisory Committee (GAAC) & Environmental Commission Chair Mike Furrey, to join the Task Force.

Mayor Shortway explained he has met with Township Engineer to begin work on the Water Use and Conservation Plan which will be funded by a $80,000 grant by the Highlands Council. He added he continues to strive to create well-being for all residents through passive recreation, hiking, biking trail system that will join the commercial resort area to the Town Center. The $2,000 grant received by the GAAC will be utilized to apply for funding through ArtPlace, an arts strategy to tackle challenges and introduce arts & culture along the passive trail system.

Mayor Shortway expressed the coordination of the GAAC, Beautification Committee, the Recreation Board and newly formed Arts Committee is imperative to success for Vernon and implores the Council to recognize the value of Ms. Downtain in these efforts and to consent to her appointment as Director of Recreation and Community Development.

Items for Discussion

Personnel—Resolution 17-50

Council Member Rizzuto commented this is not about Mishelle Downtain personally but doesn’t feel position should be given a 35% raise due to the reduced responsibility given to the PAL. Council President Murphy stated it is a promotion of job title. Mayor Shortway added the Township Code states Vernon has a Director who coordinates recreation facilities, programs with PAL and non-profit groups. Council President Murphy explained originally, we had a full-time Director and a part -time aide but when previous Director left, Ms. Downtain took over the roll. Council Member Ooms opined that Ms. Downtain is doing a good job but has requested her credentials and experience that are needed for this position. Council Member Wetzel stated the position includes Community Development and questioned if Ms. Downtain has knowledge of Taxes, Zoning and sewers to assist new business prospects. Mayor Shortway added that recreation is part of tourism and because she has been given additional duties, she may file a civil service desk audit for a determination of her title.

Council President Murphy asked if Ms. Downtain wanted to come forward to answer questions. Council Member Ooms commented the Recreation Director should have certifications and supervisory qualifications. Ms. Downtain explained she has three years’ experience in the department one performing the director’s roll, and an associate’s degree in psychology with high honors which is a main criteria for the position in question.

Jeanne Buffalino, commented that Ms. Downtain works with the PAL, the Recreation Board, assists in the Township sponsored programs, works with all Vernon sports groups in allotting field usage and works with DPW employees in maintenance of fields among her other departmental responsibilities.

Christa Geary, as a senior citizen in Vernon, commented Ms. Downtain is a valuable asset who successfully runs the senior picnic and brings new ideas to the center and feels she is deserving of salary of $45,000.

Denise Urbaniak, feels Ms. Downtain has brought a revitalization to Recreation in Vernon with the Trail Challenge, Sustainable Jersey Grant and promoting the town positively for all ages and guide the Township in the right direction.

MUA Progress—Lift Station and Declaratory Judgment

Mr. Zielinski explained a complaint was filed asking for a declaratory judgment of ownership of the lift stations and an answer should come in mid-March.

Liquor License Fees

All Council members discussed proposed increase in liquor license fees allowable per state statute. Ms. Kirkman explained the review and investigation process done for each liquor license by the Clerk and Police Departments is time consuming and should be funded by licensees not the taxpayers. Ms. Kirkman explained the rate increase is decided upon by the Council, noting that the township had begun a rate increase process but halted it in 2012 resulting in an uneven application of the rates. .

Mr. Zielinski stated he met with Office of Attorney General regarding Mountain Creek and Minerals renewals and determined Mountain Creek license has been resolved and Minerals will need to provide the Township an affidavit with required minimum amount of rooms to renew current license and thanked Ms. Kirkman for her assistance to get this resolved.

Resolution #17-54: Approval to Submit a Grant Application and Execute a Grant Contract with the New Jersey Department of Transportation for the Maple Grange Road Improvements Project

WHEREAS, Vernon Township desires to apply for a 2017 Municipal Aid Grant from the New Jersey Department of Transportation for road improvements to Maple Grange Road.

NOW, THEREFORE, BE IT RESOLVED that the Vernon Township Council of the Township of Vernon, County of Sussex, State of New Jersey formally approves the grant application for the above stated project.

BE IT FURTHER RESOLVED that the Mayor, Engineer, and Chief Finance Officer are hereby authorized to submit an electronic grant application identified as MA-2017-Maple Grange Road Improvements-00163 to the New Jersey Department of Transportation on behalf of Vernon Township.

BE IT FURTHER RESOLVED that the Mayor and Municipal Clerk are hereby authorized to sign the grant agreement on behalf of Vernon Township and that their signatures constitute acceptance of the terms and conditions of the grant agreement and approve the execution of the grant agreement.

Resolution #17-55: Resolution for Calculation for Reserve for Uncollected Taxes

WHEREAS, the prior year tax collection rate is used to calculate the Reserve for Uncollected Taxes; and

WHEREAS, pursuant to N.J.S.A 40A:4-41c(2) states:

“If tax appeal judgments of the county tax board pursuant to R.S.54:3-21 et seq., or the State tax court pursuant to R.S.54:48-1 et seq., result in tax reductions for the previous fiscal year, the governing body of the municipality may elect to calculate the current year reserve for uncollected taxes by reducing the certified tax levy of the prior year by the amount of the tax levy adjustment resulting from those judgments.”; and

WHEREAS, 2016 taxes were reduced by court tax judgments in the amount of $458,075.30;

NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Vernon, in the County of Sussex, State of New Jersey, that the 2016 tax levy be reduced by $458,075.30 in calculating the tax collection rate used for the Reserve for Uncollected Taxes.

Resolution #17-56: Transfer Resolution—Fund Balance Transfer

WHEREAS, the Township of Vernon Municipal Budget requires certain modifications to cover potential expenses that may occur in excess of the original budget;

Resolution #17-58: Authorizing Application and Execution of the “2017 Distracted Driving Crackdown U Drive U Text Upay” Grant Administered by the National Highway Traffic Safety Administration

WHEREAS, the Vernon Township Police Department wishes to apply for funding from the National Highway Safety Administration “2017 Distracted Driving Crackdown U Drive U Text U Pay” Grant; and

WHEREAS, distracted driving is a dangerous epidemic on America’s roadways and in 2014 alone, 3179 people were killed and 431,000 people were injured in distracted driving crashes. Driver inattention is the most insignificant cause of fatal and incapacitating crashes; and

WHEREAS, distracted driving is any activity that diverts a person’s attention away from primary task of driving which includes texting, using a cell phone, eating and drinking, reading, grooming, using a GPS or radio among others; and

WHEREAS, Vernon Township will initially incur the cost of the program not to exceed $5,500.00 and then will submit the necessary documentation to the Division of Highway Traffic Safety for total reimbursement.

NOW THEREFORE BE IT RESOLVED, Vernon Township declares its support for the “2017 Distracted Driving Crackdown U Drive U Text U Pay” Grant from April 1 through April 21, 2017 to raise awareness about the dangers of distracted driving; and

BE IT FURTHER RESOLVED, by the Township Council of the Township of Vernon, County of Sussex, State of New Jersey, that the Mayor, CFO and Township Clerk are hereby authorized to execute and sign any and all documents in order to effectuate the receipt of the Grant monies between the Township of Vernon and the Division of Highway Traffic Safety for the “2017 Distracted Driving Crackdown U Drive U Text U Pay” Grant.

Resolution #17-59: Resolution Awarding a Contract to Realty Appraisal Co., for the Revaluation of Real Property for Assessment Purposes

WHEREAS, Resolution No.: 16-273, approved on December 12, 2016, authorized Vernon Township to use the Competitive Contracting Law, N.J.S.A. 40A:11-4.1 et seq., to award a contract for the revaluation of real property for assessment purposes; and

WHEREAS, Vernon Township issued a Request for Proposals (“RFP”) seeking a vendor that is expected to complete a revaluation of real property for tax year 2018 in order to comply with an order issued on by the Division of Taxation in the New Jersey Department of the Treasury; and

WHEREAS, the Contract is being awarded pursuant to a fair and open process pursuant to the New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.4, et seq.; and

WHEREAS, the responses to the RFP were opened in public and reviewed by Vernon Township officials in accordance with law, who recommend that the contract be awarded to Realty Appraisal Co., for an amount of $809,000.00; and

WHEREAS, the Township will adopt a special emergency bond ordinance to effectuate payment for this contract and at that time the Chief Financial Officer will certify that funds are available to pay for the Contract.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE TOWNSHIP OF VERNON, COUNTY OF SUSSEX, and STATE OF NEW JERSEY, that:

  1. Realty Appraisal, Co., is hereby awarded the contract to perform a full revaluation of real property for assessment purposes, pursuant to N.J.S.A. 40A:11-4.1. et seq.
  2. The contract is awarded at a cost of up to $809,000.00 contingent upon the adoption of a special emergency bond ordinance and subject to the 2017, 2018 and/or 2019 budget.
  3. The language of the RFP, followed by the language of the bid response provided by Realty Appraisal Co., constitutes the binding language of the base contract.
  4. Subject to any modifications as may be deemed necessary or appropriate by the Township Attorney, the Mayor, or the Business Administration, the base contract may be modified provided that any subsequent agreement do not materially alter what was specified in the RFP.

Resolution #17-62: Authorizing the Vernon Township Council to Approve a Person-to-Person and Place-to-Place Transfer of Liquor License #1922-33-007-014

WHEREAS, an application has been filed for a person-to-person and place-to-place transfer of a Plenary Retail Consumption License #1922-33-007-014, for the purpose of changing the name of licensee wherein the sale, service and storage of alcoholic beverages are authorized; and for the purpose of transferring the licensed premises from “inactive, pocket” status to “active” status at the location set forth below; and

WHEREAS, the submitted application form is complete in all respects, the transfer fees have been paid, and the license has been properly renewed for the current license term.

NOW, THEREFORE, BE IT RESOLVED that the Township Council of the Township of Vernon does hereby approve, effective as of December 22, 2016, person-to person and place-to-place transfer of the Plenary Retail Consumption License #1922-33-007-014, located at 200 Route 94, Vernon Township, New Jersey to transfer from Mountain Creek Beverages Corp. to Appalachian Liquors Corp., as delineated in the application form.

Resolution #17-57: Authorizing Execution of an Agreement with the Morris County Cooperative Pricing Council to Renew Membership Therein for the Period of October 1, 2016 through September 30, 2021

WHEREAS, the Morris County Cooperative Pricing Council (“MCCPC”) was created in 1974 to conduct a voluntary cooperative pricing system with municipalities, boards of educations, and other public bodies located in the County of Morris and adjoining counties; and

WHEREAS, the purpose of the MCCPC is to provide substantial savings on various goods and services to its members through the cooperative public bidding process; and

WHEREAS, the Township of Vernon desires to enter into an Agreement with the MCCPC, which is administered by Randolph Township as Lead Agency, to renew its membership in the MCCPC for the period of October 1, 2016 through September 30, 2021.

BE IT RESOLVED, by the Township of Vernon, County of Sussex, State of New Jersey as follows:

  1. Mayor Harry J. Shortway of the Township of Vernon hereby authorize the execution of an Agreement with the Morris County Cooperative Pricing Council by the Township of Randolph as Lead Agency dated October 1, 2016 pursuant to N.J.S.A. 40A:11-11(5). Said agreement is for renewal of membership in the MCCPC for a five (5) year period from October 1, 2016 through September 30, 2021.
  2. The Township of Vernon Municipal Clerk is hereby directed to submit a copy of this adopted Resolution, along with an executed Agreement, to Randolph Township as Lead Agency of the MCCPC.
  3. This Resolution shall take effect immediately upon final passage according to law.
  4. All appropriate Vernon Township officials are authorized and directed to perform all required acts to affect the purpose of this Resolution.

Introduction/1st Reading of Ordinances

Ordinance #17-02: An Ordinance of the Township of Vernon, County of Sussex, State of New Jersey Authorizing the Sale of Property Owned by the Township and Not Required for Public Purposes and More Commonly Known as Block 142.01, Lot 1

Council Member Ooms expressed that an appraisal should be done and 90-day permit time is unrealistic. Council Member Rizzuto agreed that an appraisal be done to consider the value of the property if water and sewer were added to that area. Council President Murphy added there already are 11 tax exempt lots and adding water to that area may not be justifiable based upon the costs. Council Member Ooms added the Township must get an appraisal, use better marketing strategy to get the best outcome for Vernon.

Mr. Zielinski explained the property must be publicly auctioned and if no offers price can be lowered at a new auction and noted that buyers are bound by stipulations in contract.

Council Member Rizzuto moved for the item to continue to be tabled until an appraisal was done. Council President Murphy requested that the Township contact the Board of Education to see what their intentions are with the surrounding buildings as they are moving their location. Council Member Ooms requested that the appraisal be done, that the time frame for work be expanded and a marketing strategy be created outside of Vernon (Bergen, Essex, Union County). The Council and Attorney Zielinski discussed having the property marketed by a commercial realtor or auction house.

The Council discussed possibly tabling the ordinance; however a consensus was made to simply not introduce the ordinance at this time.

Council Comments

Council Member Rizzuto praised the Vernon Police for excellent job in recent investigations. Council Member Rizzuto requested having the presentation for the study done by Remington & Vernick on a Saturday when more residents are able to attend. Council President Murphy added that first we need to find out if presenter as well as MUA members are available to attend on a Saturday. Mayor Shortway will ask Remington & Vernick if Saturday March 11 is doable and will report back to Council on February 27, 2017.

Council Member Ooms questioned if anyone read the article about electric co-op being formed to reduce expenses for public, no one had further information. Ms. Ooms asked Ms. Yetter if when preparing the bond schedules she could list all bonded items on sheet and the price when purchased for better tracking. Ms. Ooms commented about the specific requirements she felt are needed for the Recreation Director position noting she stands by her personal principles and is disappointed with social media posts. Mayor Shortway responded he used Facebook to notify the public and will not give up his first amendment rights.

Council Member Kadish maintained it is the Mayor’s right to appoint the department head position and it is inappropriate to question the job description at this point.

Council President Comments

Council President Murphy stated the County Board of Chosen Freeholders will be having their regular meeting at the Vernon Township Municipal on March 22, 2017 beginning at 7:00 pm. Ms. Murphy noted an email the council received regarding support for resolution banning animal cruelty at pet shops or puppy mills and requested advice from Tom Maellaro, Vernon Township Animal Control Officer to consider adoption of resolution. Council President Murphy stated in NJ Herald, Sunday edition, there were 140 foreclosure notices, 32 were in Vernon, purchase years scattered from1989-2006 and stresses that people are struggling. Council President Murphy asked Lynne Schweighardt, Vernon Assessor to come forward to discuss trends in housing foreclosures. Ms. Schweighardt explained her office does not keep track but trend has decreased in recent years from 900 down to 600 but adds one of Vernon’s top tax payers is the Federal Loan Association. Mr. Zielinski explained the state provides information on the judiciary webpage but does not designate a state advocate to help in foreclosure process.
