The meeting of the Township Council of the Township of Vernon was convened at 7:30 p.m. on Monday, September 14, 2015 in the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey with Council President Patrick Rizzuto presiding.
Statement of Compliance
Adequate notice of this meeting had been provided to the public and the press on January 4, 2015, and was posted on the bulletin board in the Municipal Building in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-7.
Roll Call of Members
Present were Council Members Dan Kadish, Jean Murphy, Dick Wetzel and Council President Patrick Rizzuto. Also present were Administrator Bill Zuckerman and Township Attorney John Ursin. Council Member Brian Lynch was absent.

Proclamations
Proclamation Recognizing and Declaring the Month of September as Childhood Cancer Awareness Month in Vernon Township
Council President Rizzuto read the following proclamation for the record:
WHEREAS, Children across New Jersey bravely fight against Burkett’s Lymphoma - Non Hodgkin’s Lymphoma, a form of pediatric cancer; and
WHEREAS, in gratitude to all those who helped the children and their families on their journeys to recovery, the Township of Vernon would like to help raise awareness for childhood cancer; and
WHEREAS, each year, pediatric cancer interrupts children’s lives and limits the potential of thousands of young Americans, and it remains the leading cause of disease- related death for children; and
WHEREAS, September has been declared as National Childhood Cancer Awareness Month and in effort to raise awareness everyone is encouraged to go GOLD to show support and promote recognition of those young lives affected by cancer; and
WHEREAS, during Childhood Cancer Awareness Month, we come together to remember all those whose lives that were cut short by pediatric cancer, to recognize the loved ones who know too well the pain it causes, and to support every child and every family battling cancer each day. We join with their loved ones and the researchers, health care providers, and advocates who support them as we work toward a tomorrow where all children are able to pursue their full measure of happiness without the burden of cancer.;
Now therefore, be it proclaimed, by the Mayor and Council of the Township of Vernon that September 2015 shall be known as childhood cancer awareness month in the Township of Vernon.
Council President Rizzuto thanked Patricia DaSalvia for bringing this cause forward on behalf of her son Nicholas.
Prostate Cancer Awareness Month
Council President Rizzuto read the following proclamation for the record:
WHEREAS, Prostate Cancer is a serious threat to men’s health across New Jersey and the nation, and
WHEREAS, while the causes of Prostate Cancer are still unknown, men with certain risk factors may be more likely to develop the disease and most men who suffer from Prostate Cancer are over the age of 65 and those whose fathers, brothers, or sons have had the disease are also at greater risk, and African American men experience both the highest incidence and the highest mortality rates; and
WHEREAS, increased public awareness of this disease, its risk factors, and its symptoms may save lives as men across New Jersey learn to recognize the warning signs of Prostate Cancer as listed at Cancer.gov; and
WHEREAS, Prostate Cancer is treatable when detected early, and prompt treatment can significantly reduce the suffering and deaths caused by this disease.
NOW THEREFORE BE IT RESOLVED, by the Township Council of the Township of Vernon that the MONTH OF SEPTEMBER shall be proclaimed PROSTATE CANCER AWARENESS MONTH in the Township of Vernon, and that we encourage citizens to stand together against this disease.

Krista Gerry, stated that she has lived in Vernon for 43 years and acknowledged that the Senior Picnic at the PAL building as being well organized and that recreation was doing a great job. Ms. Gerry stated the VFW gives financial and social support to Veterans. Ms. Gerry stated they lobby Congress to assist veterans and donate money for free phone calls for soldiers. Ms. Gerry requested the petition question for the VFW go on the ballot and they be exempt from the sewer fee.
Sally Rinker, Vernon stated that a letter had been sent regarding the petition. Ms. Rinker stated that the committee of petitioners had submitted a petition that had a sufficient number of signatures to waive the sewer connection fee for the VFW from the Vernon MUA. Ms. Rinker stated there was a list of deficiencies. Ms. Rinker stated she did not understand the deficiency relating to the circulators. Ms. Rinker characterized the deficiency as bizarre. Council President Rizzuto stated same was explained to Ms. Rinker earlier that day and then Ms. Rinker was referred to the attorney if she still did not understand it and needed further clarification. Ms. Rinker stated because the deficiency was unclear and makes no sense, it was now settled Ms. Rinker noted that the Attorney indicated in his letter that Ms. Rinker was advising the committee of petitioners and advocating on their behalf. Ms. Rinker acknowledged same and thanked the Township attorney for validating her position. Ms. Rinker stated that the petitions are now certified and all the deficiencies have been met except for the one that makes no sense to her. Ms. Rinker also commented that if there was an innuendo that the circulators who signed the petition were not actually the ones who signed the petitions; that is completely erroneous. Ms. Rinker stated that only the persons who circulated the petition were members of the VFW. Mr. Thomas stated he concurred. Ms. Rinker was accompanied by Bob Constantine and Russ Thomas.
Gary Martinsen stated there is a resolution on the agenda for Vernon Vibes and there is no whereas clauses. Mr. Martinsen said there is no explanation as to why they want it removed. Mr. Martinsen said it would be easier if there was some explanation. Mr. Martinsen stated the VFW was a political football. Mr. Martinsen stated the attorney made statements that were inappropriate. Mr. Martinsen said the same was true in the salary petition. Mr. Martinsen said the election numbers were different. Council President Rizzuto stated that was because the Township was advised that they were to use the number of the June primary and we have the correspondence to document that, then the County came out with a second number. Council Member Murphy stated that she had obtained a letter where the county had narrowed down the spreadsheet the Township had been using. Council Member Murphy stated that spreadsheet was not distributed, Attorney Ursin stated that spreadsheet was specifically referenced in the memo he had provided. Council Member Murphy stated that according to the Board of Elections there were a sufficient number of signatures and that entire fiasco was not necessary over and above the purging. Council President Rizzuto stated that if you review the summary there is a filter used in the report and when you review the two reports the one that was given to the members of the public some of the groups of voters were not included. Council President Rizzuto stated however the issue is now moot because the question is on the ballot. Council Member Murphy stated she did not believe it was not moot.

Items for Discussion
An Ordinance to Waive the Sewer Connection Fee Established by Vernon’s Municipal Utilities Authority for the Veterans of Foreign Wars
Attorney Ursin explained the Clerk reviews petitions for procedural deficiencies only and the Council would acknowledge the report and that is the first reading. The Council would then place it on the agenda for a second reading. Attorney Ursin stated there were deficiencies recognized in the petition, however in the big scheme of things they are relatively minor. Attorney Ursin explained a petition is an attempt to, through the ballot process, have the Council adopt legislation which is in keeping with the Council’s legislative authority and jurisdiction. Attorney Ursin stated the petition process had to be over a subject that the Council has jurisdiction. Attorney Ursin said the cases are clear and the law is clear on this issue. Attorney Ursin stated that there are several court cases about this and when a petition is presented and it is outside the jurisdiction of the Council the court states it is “void on its face.” Attorney Ursin explained that the MUA had been created under the state statute and it is an independent authority under 14B of the utilities law. Attorney Ursin stated that the legislature talked extensively about the reasons for a utility authority which includes that it operates its job and jurisdiction separate and distinct from the political process. Attorney Ursin stated that was the reason the legislature gave for creating authorities and once created they had authority over the subject matter. Attorney Ursin stated that what this petition is asking that what you do is overrule the rules and regulations of the VTMUA and a decision of the VTMUA and in either case that would be improper and illegal for the Council to do. Attorney Ursin stated this petition is void on its face and my recommendation is you take no action to further this petition. Attorney Ursin stated in regards to the deficiencies, the Council can explore them if they wish to but they are moot. Attorney Ursin stated it would not matter if there were no deficiencies the subject matter of the petition is beyond the authority and jurisdiction of the Council. Attorney Ursin stated in this case it is not a close call, this is reversing the administrative and legislative scheme and simply not a close call. Council Member Murphy questioned about the circulators signing the petition and other deficiencies. Clerk Kirkman explained that the circulators were simply being asked to sign the petition that they circulated. Clerk Kirkman noted that the notary issue had been corrected, the committee member who had not signed had been corrected. Council Member Kadish asked if the Clerk was now certifying the petition. Clerk Kirkman noted that there was still one deficiency outstanding at that time. Council Member Murphy stated that if people in the town put together the petition, it should go to the ballot. Council Member Murphy stated there is no reason to keep it from the ballot it is for the people to vote on it. Council Member Murphy stated there is always a way to kill a petition. Council Member Murphy stated that as far as she was concerned there was a valid petition with one deficiency where the four petitioners would have to add their signature and based on that, the petition should move forward. Council Member Murphy stated the petition should go to the County Clerk to be put on the ballot. Attorney Ursin stated the time for putting an item on the ballot for the general election has already passed. Council Member Murphy stated that is not for the Township to say, that is for the County Clerk to determine. Council Member Murphy stated the petition is just about certified and should go to the County Clerk. Council Member Murphy stated the County Clerk should make that decision not anyone else. Attorney Ursin said your decision tonight is to accept the petition from the Clerk and list it for the next reading or not.

Council President Rizzuto stated simply because the intent is good the Council is not able to receive a petition on this subject matter and we are simply opening up the town to additional litigation. Council President Rizzuto explained the cost of the sewer hook up must be born by the users of the MUA and therefore the Council simply does not have the authority to act on the matter. Council President Rizzuto stated this is similar to the Council trying to raise the speed limit on a state highway, the Council does not have the authority. Council Member Wetzel stated he is a firm believer of the VFW and contributes to their fund. Council Member Wetzel stated he has 5 uncles in the VFW. Council Member Wetzel stated this is something that is illegal and we cannot deal with it. Council Member Wetzel stated it is not something we don’t want to do, we just don’t have the authority and if we did who would bear the burden of this, you the taxpayer. Council President Rizzuto stated that he sat down with the Post Commander and reviewed several stream of revenue programs. Council President Rizzuto stated the process has begun for a license to sell and hold bingo and raffles. Council President Rizzuto explained that he had met with Post Commander Davis and they were going to have other activities. Council President Rizzuto stated the VFW understood the position the Township was in. Council President Rizzuto noted his son was a retired Lt. Colonel and he was the son of a Purple Heart recipient and would be honored to help the VFW in anyway but it would simply be leading them down the wrong path to lead them to believe we could do something we cannot. Council President Rizzuto pointed out that Mayor Marotta, himself, Council Member Wetzel and Lynch worked to hard to establish the veteran’s cemetery and to obtain a donation for the VFW for $5000 from a private business. Council President Rizzuto stated to say we are unsympathetic is not true we must work within the law.
Council Member Murphy stated if a non profit wants to come forward and put a petition on the ballot they can, we have a valid petition it must go to the County Clerk. Council Member Murphy stated the County Clerk makes the determination. Council Member Murphy stated Attorney Ursin’s letter was very crafty and was written without consulting the Council. Council Member Murphy stated she had to read in the paper what was occurring. Council Member Murphy stated that she was not impressed with what Attorney Ursin had to say and it was up to the Council to send it to the County Clerk to put it on the November ballot and that is the only issue at hand. Council Member Murphy said someone is trying to stonewall it for whatever reason. Council Member Murphy questioned the information that was giving on the last petition and stated she was happy to provide it. Council Member Kadish asked Attorney Ursin to explain the by-laws of the MUA. Attorney Ursin explained that was about emergency situations and recommendations from the Council. Council Member Murphy questioned the attorney regarding if we have a valid petition and do not take action. Attorney Ursin explained the Township does not have a valid petition in front of it. Attorney Ursin stated you are mixing apples with oranges, you have valid signatures on an invalid petition. Council Member Murphy stated no, we need four more signatures and the petition will be valid. Council President Rizzuto called for a vote.

Council Member Murphy questioned if the initial money coming for this resolution was coming out of COAH and if the Township could opt out. Attorney Ursin stated that it was and the Township could opt out if less than 70 towns sign up. Attorney Ursin noted there may be extra costs if it is necessary to call witnesses for a court proceeding.

Resolution #15-153: Authorizing Placement of Signs in Various Locations (Vernon Hockey)
WHEREAS, Vernon Hockey has requested permission from the Township Council to place 12 signs in front of various businesses in town to advertise their Mud Run at Rickey Farm; and
WHEREAS, The Vernon Hockey is requesting permission for the 12" x 24" signs to be securely placed; and
WHEREAS, Vernon Hockey has requested to place the signs from September 15, 2015 through September 27, 2015 and thereafter they will promptly remove them; and
WHEREAS, the Township Code Enforcement Officer has advised that pursuant to the Vernon Township Code 330-180 that the placing of multiple signs of this size and character requires permission of the Council for their placement.
NOW THEREFORE BE IT RESOLVED, by the Council of the Township of Vernon that Vernon Hockey Mud Run is granted permission to place signs, as described above, at various businesses, from September 15, 2015 till September 27, 2015, in association with their Vernon Hockey provided all other requirements of Township Code 330-180 are followed.
Resolution #15-154: Resolution Setting the Salary for a Non-Union Employee
WHEREAS, the Township of Vernon is required to have a certified Tax Collector pursuant to N.J.S.A 40A:9-141 and a Tax Search Officer; and
WHEREAS, Lisa Kimkowski is licensed by the State of New Jersey to perform the duties of a municipal tax collector and tax search officer and meets all other qualifications for the position; and
WHEREAS, the salary range for the tax collector per Ordinance 15-20 is $55,000 to $75,000; and
WHEREAS, the Chief Financial Officer pursuant to N.J.S.A. 40:69-A-43(d) has offered the full-time position of Tax Collector and Tax Search Officer at a salary of $65,000.00 per year to Lisa Kimkowski and she has agreed to accept the same; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Vernon, County of Sussex, State of New Jersey, that Lisa Kimkowski’s salary be set at $65,000 per annum.
Resolution #15-155: Acceptance of Performance Bond from United Water New Jersey for Watermain Replacement for High Point Terrace in the Sussex Hills Section of Vernon Township
WHEREAS, United Water, NJ has submitted plans to Vernon Township for a water main replacement project on High Point Terrace in the Sussex Hills section of Vernon Township; and
WHEREAS, the Township Engineer, Cory Stoner has reviewed and approved the final plans, prepared by George Lavatelli, P.E. with a requirement of a performance bond of 120% of the estimated cost of this project be posted; and
WHEREAS, based on the estimated cost of the project, the Township Engineer is requiring a performance bond in the amount of $420,614.68 submitted to Vernon Township prior to the start of the project by United Water NJ.
WHEREAS, the Township Engineer and Township Attorney have reviewed and approved the said performance bond submitted by United Water and recommends acceptance by the Township Council.
NOW THEREFORE BE IT RESOLVED, by the Council of the Township of Vernon, authorization to accept a performance bond in the amount of $420,614.68 submitted by United Water, NJ for water main replacement project on High Point Terrace, in the Sussex Hills section of Vernon Township; and
BE IT FURTHER RESOLVED, the performance bond can be formally released when construction has been completed and approved by the Township Engineer and further accepted by the Township Council by way of Resolution; and
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the Department of Public Works for their records.
This Resolution will take effect immediately according to law.
Resolution #15-156: Authorizing the Award of Contract for Construction of Asphalt Pad for Department of Public Works Salt Dome
WHEREAS, there is a need for construction of an Asphalt Pad for the Proposed Salt Dome for use by the Vernon Township Department of Public Works for storage of road salt material;
WHEREAS, the Township has issued specifications and contract documents soliciting formal bids for the necessary work; and
WHEREAS, the Township of Vernon received four (4) bids for the above referenced project on Thursday September 3, 2015 at 10:00 a.m.; and
WHEREAS, after review by the Township Engineer Cory Stoner, the lowest bidder, C&V Paving Contractors, Inc. P. O. Box 156 Swartswood, NJ, 07877, fully met the bid requirements and is recommended to be awarded the contract for the amount of $36,400.00; and
WHEREAS, the Chief Finance Officer has certified funds available for this purpose in Account #3095857, Ordinance#15-16.
NOW, THEREFORE BE IT RESOLVED by the Vernon Township Mayor and Council, County of Sussex, State of New Jersey to award the bid to C&V Paving Contractors, Inc. P. O. Box 156, Swartswood, NJ, 07877, in the amount of $36,400.00 for construction of an Asphalt Pad for the Proposed Salt Dome for use by the Vernon Township Department of Public Works.
This Resolution shall take effect immediately according to law.
Resolution #15-157: Authorization to Execute a Developer’s Agreement with New Jersey CVS Pharmacy, Inc. in Relation to Preliminary and Final Site Plan and Subdivsion
WHEREAS, New Jersey CVS Pharmacy, Inc. received Land Use Board approval for Preliminary Site Plan and Subdivision approval on September 10, 2014, Final Site Plan and Subdivision approval on December 10, 2014, and a final modification of non-significant conditions on August 26, 2015, for Block 144.01, Lots 1, 2, 3 and 4; and
WHEREAS, the Developer and the Township entered into a Developer’s Agreement setting forth the rights, duties and obligations of the parties in connection with the Approvals for the properties; and
WHEREAS, the Developer appeared before the Land Use Board on August 26, 2015 seeking to eliminate the requirement for shared parking set forth in the original September 10, 2014 Resolution as condition no. 11 and in the Developer’s Agreement adopted by the governing body in paragraph 15 and also for not being able to work on Saturdays as contained in condition no. 22 and in the Developer’s Agreement adopted by the governing body in paragraph 3; and
WHEREAS, the Land Use Board at its hearing determined that these conditions and terms were non-significant and could be eliminated; and
WHEREAS, the governing body seeks to alter the Developer’s Agreement by eliminating paragraph no. 15 and also allowing the Developer to work on Saturdays; and
WHEREAS, the Developer desires to proceed with the development of the properties and to install the improvements as shown on the Plats for which the Approvals were, or are about to be received; and
WHEREAS, this agreement is solely intended to memorialize the Developer’s obligations with respect to the construction of the pharmacy and related improvements.
NOW, THEREFORE, BE IT RESOLVED, that the Township Council of the Township of Vernon, does hereby authorize the Mayor and Township Clerk to amend the executed Developer’s Agreement with New Jersey CVS Pharmacy, Inc. for property known as Block 144.01, Lots 1, 2, 3 and 4 as shown on the Tax Map of the Township of Vernon pursuant to the final Land Use Board Resolution adopted on September 9, 2015, a copy of which is on file with the Secretary for the Land Use Board.
This Resolution shall take effect immediately upon adoption according to law.

Council Comments
Council Member Wetzel stated you cannot deny freedom of speech if you do not want to watch the show you can turn it off. Council Member Wetzel stated if you don’t want to watch, don’t; you cannot deny freedom of speech.
Council Member Kadish stated it is not an issue of freedom of speech but of decorum and do we want a link to it on our township website; that is the issue. Council Member Kadish stated the way people are treated is deplorable. Council Member Kadish read a letter he received from the Township Attorney. Council Member Kadish indicated that Mr. Ursin had written to him indicating he had heard from multiple sources that Council Member Kadish had said that Mr. Ursin was acting with improper motives, the letter continued stating that those allegations were completely false and without factual basis and the reckless comments were actionable. Council Member Kadish indicated Mr. Ursin’s letter indicated that his professional relationships were very important to him and he must advise that he would no longer tolerate misstatements from Council Member Kadish that implicated Mr. Ursin’s integrity. Council Member Kadish asked the purpose of the letter. Attorney Ursin stated that false statements about me were attributed to you and I wanted to advise you that I had heard them and ask you to stop making them. Council Member Kadish questioned the sources. Council Member Kadish questioned why he had received a threatening letter. Attorney Ursin stated a private letter between the two of us, he felt was the best way to handle the matter. Council Member Kadish stated he felt the best way to handle it was the way he just did.
Council Member Murphy stated that Mayor Marotta has freedom of speech but not on the Township website, does [candidate] Gary Martinsen get a link also, will United Water also sponsor a show for him on the Township Website. Council Member Murphy questioned if anyone can put a link on the Township website. Council Member Murphy stated you should not attach a private show to a government website; it simply does not belong on a township website. Council Member Murphy stated she was hoping that Council Member Lynch was at the meeting. Council Member Murphy handed out an item to the Council about N.J.S.A. 40A: 9-165. Council Member Murphy stated that the Municipal Clerk had been hired in March 2014. Council Member Murphy stated she had discussed with the Council President and all the members of the Council, here, about increases. Council Member Murphy was advised that N.J.S.A. 40A: 9-165 regulates increases. Council Member Murphy indicated that in July 2014 the 3 other statutory employees received a raise but the clerk did not. Council Member Murphy stated that the statute indicated that if one gets a raise they all are entitled to a raise. Council Member Murphy indicated that you may say that the clerk did not because the employee was only with the Township for four (4) months but when our prior CFO was hired in August 2009; he received a raise after being employed with the Township for just five (5) months under the same administration. Council Member Murphy indicated that the four (4) statutory employees are required to get a raise at the same time, she is providing the documents to show this did not happen. Council Member Murphy stated this was one of the reasons she wanted the clerk separated out to keep the clerk out of political rhetoric. Council Member Murphy also indicated increases were given in 2014 but the budget for 2014 was much lower than the actual increases that were given. Council Member Murphy indicated a $4200 increase was given just because and the Business Administrator received a 20% pay increase and these were unauthorized increases. Council Member Murphy stated she had questioned Attorney Ursin previously regarding increases to the four (4) statutory employees and Mr. Ursin had indicated that if one got it they all got it. Council Member Murphy stated she never heard from anybody after this was distributed. Council Member Murphy stated things should be done fair and she would like to see this addressed.
Council President Rizzuto indicated that school has started and asked that you please be careful in regards to driving as children are going to and from the bus stops for the first time and may be unfamiliar with their surroundings. Council President Rizzuto stated that he is steadfast in his support of the Veterans but even if the cause is worthwhile it does not make it legal. Council President Rizzuto expressed that it was not in the purvey of the Council.
Council Member Lynch was not present.
Adjournment
There being no further items of business to be conducted on the agenda, a motion for Adjournment was made by Council Member Wetzel, seconded by Council Member Kadish with all members voting in favor.
