RESOLUTION #R07-204

AUTHORIZING SCMUA TO ADVERTISE FOR BIDS FOR PHASE III UPPER WALLKILL EXPANSION PROJECT TO SERVE VERNON TOWN CENTER

WHEREAS, the Sussex County Municipal Utilities Authority has completed design of the Phase III Upper Wallkill Treatment Plant Expansion (Contract No. 601A), Vernon Regional Force Main (Contract No. 601B), and Reclaimed Water Recharge Fields (Contract No. 601C), and construction plans and specifications associated therewith are in biddable form; and

WHEREAS, the Sussex County Municipal Utilities Authority has obtained the required NJPDES discharge permit, and all required TWA permits, stream encroachment permits, wetlands related permits, NJDOT permits, and Hamburg Road Opening permits, and reviews of applications for local building permits from Hardyston Township and Vernon Township have been completed, and such permits will be issued upon selection of contractors for the various construction contracts; and

WHEREAS, SCMUA has acquired the property to be utilized for the above referenced Recharge Fields, and is in the process of acquiring the required pipeline easement; and

WHEREAS, SCMUA has negotiated an acceptable price for the purchase of United Water VSTC Pumping Station #3 and ten (10") inch diameter force main, to be incorporated in the Phase III Project; and

WHEREAS, SCMUA has obtained all requisite approvals from the Local Finance Board and the Sussex County Board of Chosen Freeholders to issue the Bonds required to construct the Phase III Project; and

WHEREAS, Vernon Township and Mountain Creek have reached agreement on all outstanding issues, and Mountain Creek has committed to provide the required Letter of Credit in an amount of $ , said Letter of Credit to be provided within weeks of the adoption of this Resolution; and

WHEREAS, Section 201 of the SCMUA/Vernon Township Service Contract requires Vernon Township’s concurrence regarding proceeding to bid for construction contractors, prior to SCMUA issuing Notice to Bidders and receiving bids; and

WHEREAS, Vernon has provided the portion of the capital contribution required by SCMUA to date ($600,000), with the remainder to be provided prior to bid award upon receipt of notice of need for same from SCMUA; and

WHEREAS, it is in the best interests of Vernon Township to authorize SCMUA to proceed to advertisement for bids for Contracts 601A, 601B, and 601C referenced above.

NOW, THEREFORE, BE IT RESOLVED that SCMUA is hereby authorized to advertise for bids from contractors for the construction of the above referenced Contracts 601A, 601B, and 601C.

I hereby certify that the above resolution is a true copy of the resolution adopted by the Vernon Township Council at their regular meeting held on Monday, September 24, 2007 in the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey.
