RESOLUTION #R07-158

AUTHORIZING AND DIRECTING THE MAYOR AND TOWNSHIP CLERK TO SIGN A CONTRACT TO ACQUIRE A SEWER EASEMENT FROM THE VALLEY VIEW APARTMENTS

WHEREAS, the Township Council of the Township of Vernon, NJ desires to acquire a sewer easement from the Valley View Apartments which is set forth in the contract attached hereto and made a part hereof, and which constitutes a part of Block 141 Lot 10.01 on the Tax Map of the Township of Vernon, NJ, pursuant to NJSA 40A:12-1 et seq; and

WHEREAS, the land is to be used to construct a portion of the Township sewer system with accessory facilities, a public purpose.

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows.

1. The Mayor and Township Clerk are hereby authorized and directed to sign the contract to acquire an easement on a portion of Block 141 Lot 10.01 on the Tax Map of the Township of Vernon, NJ and as shown in the contract attached hereto and made a part hereof. The contract is contingent upon the Township Council approving, by Ordinance, the purchase of the property interest.

2. The Chief Financial Officer of the Township has certified the availability of funds for the purposes set forth herein. The cost of the easement is $11,000.00.

3. This Resolution shall take effect immediately.

I hereby certify that the above Resolution is a true copy of the Resolution adopted by the Vernon Township Council at their regular meeting held on Monday, the 23rd day of July, 2007 at 7:30 p.m. in the Vernon Municipal Building, 21 Church Street, Vernon, New Jersey.
