RESOLUTION #R07-146

AUTHORIZING A CONTRACT FOR THE ACQUISITION OF GOODS OR SERVICES PURSUANT TO NJSA 19:44A-20.4 AND/OR NJSA 19:44A-20.5 FROM TNH CONSULTING FOR ENVIRONMENTAL CONSULTING SERVICES FOR THE BOG TURTLE SURVEYOR FOR THE VERNON TOWN CENTER WASTEWATER COLLECTION SYSTEM – CONTRACT NO. 3

WHEREAS, the Township of Vernon has a need to acquire a proposal in the matter of Environmental Consulting for the Bog Turtle Surveyor for the Vernon Town Center Wastewater Collection System – Contract No. 3; and

WHEREAS, THN Consulting has submitted a proposal, dated June 24, 2007, indicating they will provide the proposal for the Bog Turtle Occurrence and Monitoring during the Vernon Town Center Wastewater Collection System construction – Contract No. 3 for a fee of $6,700; and

WHEREAS, the Chief Financial Officer of the Township of Vernon, has determined and certified in writing that funds are available in the amount of $6,700.00 for this purpose; and

WHEREAS, THN Consulting has completed and submitted a Business Entity Disclosure Certification which certifies that THN Construction has not made any reportable contributions to a political or candidate committee to Vernon Township in the previous one year, and that the contract will prohibit THN Construction from making any reportable contributions through the term of the contract, and

THEREFORE BE IT RESOLVED, by the Township Council of Vernon Township as follows:

1. The Township of Vernon is authorized to engage THN construction for the purpose of providing consulting services as herein described.

2. The Mayor and Township Clerk are hereby authorized and directed to execute the contract with THN Consulting.

3. Said THN Consulting shall be engaged pursuant to contract to be entered by and between THN Consulting and the Township and for such periods of time as permitted by law or as set forth in the contract, if not contrary to law, and for such compensation as agreed, not to exceed the Certification of Funds.

4. A copy of the Business Entity Disclosure Certification previously provided by THN Consulting and the Certification of Value shall be filed with this Resolution.

5. This contract is awarded without competitive bid as a Professional Services Contract under the provisions of NJSA 40A:11-5 (1) (a).

6. That a notice of this action shall be published once in the official newspaper in accordance with law, and said notice to provide that the contract awarded and the Resolution authorizing same are available for public inspection in the office of the Township Clerk.

7. This Resolution shall take effect immediately upon adoption according to law.

I hereby certify that the above resolution is a true copy of the resolution adopted by the Vernon Township Council at their regular meeting held on Monday, July 9, 2007 at 7:30 p.m. in the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey.
