RESOLUTION #R07-107
AUTHORIZING THE SALE OF TOWNSHIP OWNED SURPLUS FILL MATERIAL NO LONGER NEEDED FOR PUBLIC USE
WHEREAS, the Township of Vernon is the owner of the following surplus fill material which is no longer needed for public use; and
WHEREAS, the Township desires to authorize the sale of the above surplus material at public sale pursuant to N.J.S.A. 40A: 11-36, to the highest bidder(s).
WHEREAS, the Township of Vernon will be selling the excess material to the highest bidder(s). The material mostly has a high sand content, and may be suitable for use in septic systems or as structural fill. No guarantee is expressed or implied for these uses. Bidders are advised to inspect and test the material at their expense for their desired purposes prior to bidding. Access to the site can be arranged through the Township Engineer’s Office; and
WHEREAS, the Township will supply one (1) loader on-site, to load the material into the successful bidder(s) trucks, at no charge. Measurement for charges to the contractor will be in cubic yards, based upon the capacity of the truck, with signed tickets acquired after each loading; and
WHEREAS, the minimum amount of soil that will be bid to one individual company or contractor is 500 cubic yards. Multiple awards may be made in order to dispose of all material, at different rates, depending on the bids received. A total of 6,000 cubic yards is available. The Township reserves the right to increase or decrease this quantity depending on need.

NOW THEREFORE BE IT RESOLVED, by the Mayor and Council of the Township of Vernon, County of Sussex, State of New Jersey as follows:
1. The Township hereby declares the above described surplus fill material is no longer needed for public use.
2. The Township, its Manager, Engineer, Officers and Attorney are hereby authorized and directed to take any and all steps necessary to proceed with a public sale of said surplus fill material.
3. A total of 6,000 cubic yards of fill material is available for sale
4. The fill material shall be auctioned in minimum blocks of 500 cubic yards.
5. The minimum acceptable bid amount is $2.00 per cubic yard.
6. The fill shall be sold to the highest bidder(s) subject to the reservation of the Township to reject all bids.
7. The auction shall take place on June 7, 2007 at 1:00 p.m., in the Vernon Municipal Building, 21 Church Street, Vernon, New Jersey.
8. This resolution shall take effect immediately.

I hereby certify that the above resolution is a true copy of the resolution adopted by the Vernon Township Council at their regular meeting held on Monday, May 21, 2007 at 7:30 p.m. in the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey.
