ORDINANCE #07-51
AN ORDINANCE GRANTING AN EASEMENT FOR OVERHEAD POWER LINES ALONG BLACK CREEK DRIVE TO JERSEY CENTRAL POWER & LIGHT COMPANY
WHEREAS, overhead power lines are needed to be located along Black Creek Drive in Vernon Township to extend electrical service to the Vernon Town Center Pumpstation; and
WHEREAS, Jersey Central Power & Light Company (JCP&L) requires an easement be granted to them for the location of these power lines; and
WHEREAS, JCP&L needs to receive a guaranteed revenue to offset the cost of the capital expense of installing the overhead lines; and
WHEREAS, JCP&L has prepared an agreement document for the purpose of Vernon Township providing a guaranteed minimum monthly payment and granting an easement for the power lines; and
WHEREAS, the minimum monthly payment of $346.43 is for a period of 60 months; and
WHEREAS, this amount is a guaranteed minimum and the actual amount to be paid to JCP&L shall be the charge for the actual amount of electric used in the month plus the difference between the $346.43 and the charge for the actual amount used if the charge for actual use is less than the $346.43. If the charge for actual use exceeds $346.43, than only the amount due for actual use shall be owed for that month.
NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows.
1. The agreement set forth on Schedule A attached hereto and made a part hereof is hereby agreed to by the Township.
2. The Township agrees to the minimum monthly charge of $346.43 for 60 months and to grant the easement to JCP&L.
3. The Mayor, Township Manager and Twp. Clerk are authorized to sign the agreement document.
4. All ordinances or parts of ordinances or resolutions that are in conflict with the provisions of this Ordinance are repealed to the extent necessary.
5. If any article, section, subsection, term or condition of this Ordinance is declared invalid or illegal for any reason, the balance of the Ordinance shall be deemed severable and shall remain in full force and effect.
6. This Ordinance shall take effect after publication and passage according to law.
NOTICE
NOTICE IS HEREBY GIVEN, that the above Ordinance was introduced and passed on first reading at the regular meeting of the Township Council of the Township of Vernon, County of Sussex, State of New Jersey held in the Municipal Building on the 26th day of , November 2007, and the same came up for final passage at the regular meeting of the Township Council held on the 10th day of December, 2007, at which time, after persons interested were given the opportunity to be heard concerning said Ordinance, the same was passed and will be in full force and effect in the Township of Vernon according to law.
