ORDINANCE #07-45
AN AMENDMENT TO THE CODE OF THE TOWNSHIP OF VERNON, COUNTY OF SUSSEX, STATE OF NEW JERSEY, BY AMENDING ARTICLE IX, §99-41: SPEED LIMITS – ESTABLISHING A 25 M.P.H. SPEED LIMIT ON MAIN STREET
WHEREAS, the Township Engineer has certified to the Township Council, pursuant to NJSA 39:4-8 that the Engineer has investigated the traffic circumstances on the roadway in question, that it appears to the Engineer that it is in the best interest of public safety and the expedition of traffic that the speed limit on Main Street, between County Route 515 and State Highway 94, be established at 25 M.P.H.; and
WHEREAS, the Vernon Township Council has agreed with the conclusion of the Engineer in the Engineer’s Certification dated October 12, 2007.
NOW THEREFORE BE IT ORDAINED, by the Township Council of the Township of Vernon, County of Sussex, and State of New Jersey as follows:
Section 1. That the speed limit on Main Street is hereby established as 25 M.P.H. as follows and the Administrative Code, Article IX, §99-41 shall be so amended :

Section 2. Regulatory signs shall be erected and maintained to affect the above speed limit, subject to invalidation by the Commissioner of the Department of Transportation.
Section 3. A certified copy of this Ordinance shall be transmitted to the Commissioner of the Department of Transportation within thirty (30) days of final adoption as required by law, along with the Engineer’s Certification, a statement of reasons by the Engineer, detailed information as to the location of streets.
Section 4. This Ordinance shall take effect upon adoption according to law and subject to the invalidation of same by the Commissioner of the Department of Transportation pursuant to NJSA 39:4-8.
Section 5. Repealer, Any and all ordinances or parts thereof inconsistent with the provisions of this Ordinance are hereby repealed to such extent as they are so in conflict or inconsistent, provided, however, that the adoption of this Ordinance shall not prevent or bar the continuance or institution of any proceedings for offenses heretofore committed in violation of any existing ordinances of the Township of Vernon.
Section 6. Severability. Should any section, paragraph, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid for any reason, the remaining portions of this Ordinance shall not be affected thereby and shall remain in full force and effect, and to this and the provisions of this Ordinance are hereby declared severable.
NOTICE
NOTICE IS HEREBY GIVEN, that the above Ordinance was introduced and passed on first reading at the regular meeting of the Township Council of the Township of Vernon, County of Sussex, State of New Jersey held in the Municipal Building on the _____day of ______________, 2007, and the same came up for final passage at the regular meeting of the Township Council held on the ________ day of _____________________, 2007, at which time, after persons interested were given the opportunity to be heard concerning said Ordinance, the same was passed and will be in full force and effect in the Township of Vernon according to law.

ENGINEER’S CERTIFICATION
IN ACCORDINACE WITH VERNON TOWNSHIP ORDINANCE #07-45 REGARDING THE SPEED LIMIT ON MAIN STREET, BETWEEN, COUNTY ROUTE 515 AND STATE HIGHWAY 94 IN THE TOWNSHIP OF VERNON, COUNTY OF SUSSEX AND STATE OF NEW JERSEY
I hereby certify that I have reviewed the design and construction of the new Vernon Township Main Street, from County Route 515 to State Highway 94, and conclude that the speed limit should be established as 25 miles per hour (M.P.H.) for the reasons below:
STATEMENT OF REASONS
1. The horizontal curvature of the road was designed with radii that are considered safe for speeds up to 25 M.P.H. Higher speeds will present safety concerns.
2. The road has parallel parking provided on both sides of the road in several sections. People will not be able to safely exit and enter their vehicles if the speed limit were in excess of 25 M.P.H.
3. Although the road is largely vacant at this time, it is the Township’s intent to encourage retail and office development along Main Street over the next several years. The 25 M.P.H. speed limit will permit safer pedestrian crossings on Main Street for people who will be working at or visiting the new establishments.
I therefore recommend an ordinance be passed establishing the speed limit on Main Street as 25 M.P.H.
