TOWNSHIP OF VERNON
ORDINANCE #07-35

AUTHORIZING THE ACQUISITION OF A REAL PROPERTY EASEMENT ON BLOCK 141 LOT 10.01 FROM THE VALLEY VIEW APARTMENTS IN THE TOWNSHIP OF VERNON, COUNTY OF SUSSEX, STATE OF NEW JERSEY

WHEREAS, the Township Council of the Township of Vernon, New Jersey has adopted a Resolution authorizing the Mayor and Clerk to execute the attached contract for the acquisition of an easement on real property from Valley View Apartments pursuant to NJSA 40A:12-1 et seq; and

WHEREAS, the cost of the easement is $11,000.00; and

WHEREAS, this land will be used for the public purpose of sewer facilities.

NOW, THEREFORE, BE IT ORDAINED by the Township Council of Vernon, County of Sussex and State of New Jersey as follows:

1. The acquisition of an easement on Block 141 Lot 10.01, which property is located in Vernon, Sussex County, New Jersey is approved as set forth in the Resolution, subject to clear and marketable title. This approval is pursuant to NJSA 40A:12-1 et seq.

2. The real property being acquired is to be used for the public purpose of sewer facilities.

3. All ordinances or parts of ordinances or resolutions that are in conflict with the provisions of this Ordinance are repealed to the extent necessary.

4. If any article, section, subsection, term or condition of this Ordinance is declared invalid or illegal for any reason, the balance of the Ordinance shall be deemed severable and shall remain in full force and effect.

5. This Ordinance shall take effect after publication and passage according to law.

NOTICE

NOTICE IS HEREBY GIVEN that the above ordinance was introduced and passed on first reading at the Regular Meeting of the Township Council of the Township of Vernon in the County of Sussex, State of New Jersey held in the Municipal Building on July 23, 2007 and the same came up for final passage at the Regular Meeting of the Township Council held on August 13, 2007, at which time, after persons interested were given an opportunity to be heard concerning said ordinance, the same was passed and will be in full force in the Township according to law.
