TOWNSHIP OF VERNON
ORDINANCE #07-22

AUTHORIZING THE TRANSFER OF A RIGHT OF WAY FOR ROAD PURPOSES AND DRAINAGE EASEMENT TO THE COUNTY OF SUSSEX ON BLOCK 232 LOT 12, IN VERNON TOWNSHIP STATE OF NEW JERSEY

WHEREAS, the County of Sussex has requested a right of way for road purposes and a drainage easement on Block 232 Lot 12 in the Township of Vernon for the purpose of development and maintenance of a portion of County Route 517; and

WHEREAS, the Township of Vernon is agreeable to transferring ownership of the property described below to the County pursuant to NJSA 40A:12-13 (b) (1).

NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows.

1. The Mayor and Township Clerk are hereby authorized and directed to execute a Deed for Right of Way in fee, in perpetuity, for road purposes thereby authorizing the County its agents and assigns, and general public to pass in, over and upon all or a portion thereof for travel and maintenance of the public roadway now designated as County Route 517, and;

2. The Mayor and Township Clerk are hereby authorized and directed to execute a Deed of Easement for Drainage, an absolute and exclusive easement, in perpetuity, for discharge onto and conveyance of surface and storm water emanating from Sussex County Route 517, flow of which is being directed across the adjoining premises of Grantor as described in Deed Book 2802, at page 116. Nothing herein shall require the County of Sussex to maintain, improve of install a storm drainage system hereon.

3. All ordinances or parts of ordinances or resolutions that are in conflict with the provisions of this Ordinance are repealed to the extent necessary.

4. If any article, section, subsection, term or condition of this Ordinance is declared invalid or illegal for any reason, the balance of the Ordinance shall be deemed severable and shall remain in full force and effect.

5. This Ordinance shall take effect after publication and passage according to law.

NOTICE

NOTICE IS HEREBY GIVEN that the above ordinance was introduced and passed on first reading at the Regular Meeting of the Township Council of the Township of Vernon in the County of Sussex, State of New Jersey held in the Municipal Building on May 14, 2007 and the same came up for final passage at the Regular Meeting of the Township Council held on June 11, 2007, at which time, after persons interested were given an opportunity to be heard concerning said ordinance, the same was passed and will be in full force in the Township according to law.
