TOWNSHIP OF VERNON
ORDINANCE #07-14

AUTHORIZING THE ACQUISITION OF REAL PROPERTY LOCATED AT PART OF BLOCK 142 LOT 9 IN THE TOWNSHIP OF VERNON, COUNTY OF SUSSEX, STATE OF NEW JERSEY

WHEREAS, the Township Council of the Township of Vernon, New Jersey has passed Resolution #07-50 authorizing the Mayor and Clerk to execute a contract for the acquisition of real property from John V. McDermott pursuant to NJSA 40A:12-1 et seq; and

WHEREAS, this land will be used for the public purpose of the construction, utilization and maintenance of a municipal road and related facilities.

NOW, THEREFORE, BE IT ORDAINED by the Township Council of Vernon, County of Sussex and State of New Jersey as follows:

1. The acquisition of part of Block 142 Lot 9 set forth on the metes and bounds description, which property is located in Vernon, Sussex County, New Jersey is approved as set forth in the Contract previously authorized by the Township Council. This approval is pursuant to NJSA 40A:12-1 et seq.

2. The real property being acquired is to be used for the public purpose of constructing, utilizing and maintaining a municipal road and related facilities.

3. All ordinances or parts of ordinances or resolutions that are in conflict with the provisions of this Ordinance are repealed to the extent necessary.

4. If any article, section, subsection, term or condition of this Ordinance is declared invalid or illegal for any reason, the balance of the Ordinance shall be deemed severable and shall remain in full force and effect.

5. This Ordinance shall take effect after publication and passage according to law.

NOTICE

NOTICE IS HEREBY GIVEN, that the above Ordinance was introduced and passed on first reading at the regular meeting of the Township Council of the Township of Vernon, County of Sussex, State of New Jersey held in the Municipal Building on the 26th day of February, 2007, and the same came up for final passage at the regular meeting of the Township Council held on the 12th day of March, 2007, at which time, after persons interested were given the opportunity to be heard concerning said Ordinance, the same was passed and will be in full force and effect in the Township of Vernon according to law.
