TOWNSHIP OF VERNON
ORDINANCE #06-37

AN ORDINANCE REPLACING §250-17 OF THE ADMINISTRATIVE CODE OF VERNON .

BE IT ORDAINED by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows:

1. §250-17 of the Township Administrative Code is hereby deleted in its entirety and replaced with the following language set forth in paragraph 2 of this Ordinance:

2. § 250-17. Township Clerk

A. Alarm Registration: $10.00.

B. Raffles:

1. On premise draw raffle for cash (50/50) or merchandise (exceeding $400.00 total prize value) - $20.00 for each day on which a drawing is to be conducted under the license.

2. On premise draw raffle for cash (50/50) or merchandise (not exceeding $400.00 total prize value) – no license fee. If the raffle should exceed the $400.00 limit, then a fee of $20.00 must be submitted at the time of filing the report of operations.

3. Off premises draw raffle awarding merchandise as a prize (for each $1,000.00 or part thereof) - $20.00.

4. Off premises cash (50/50) raffle - $20.00 at application. If more than $1,000.00 is awarded, $20.00 per $1,000.00 in awarded prizes or any part thereof.

5. Calendar raffle - $20.00 for each $1,000.00 or part thereof of the retail value of the prize.

6. Instant raffle: a. $20.00 for each day on which instant raffle tickets are sold or offered for sale or; b. $750.00 for a one year license.

C. Carnival games or wheel: $20.00 for each game or wheel held on any one day or any series of consecutive days not exceeding 6 days at one location.

D. Special door prize: no fee and no license provided the merchandise is wholly donated and has a retail value less than $50.00. Such raffle cannot be conducted when other games of chance are being conducted, held or operated.

E. Golf Hole in One: $20.00 for each $1,000.00 or part thereof of the retail value of ancillary prizes.

F. Armchair Race: $50.00 per licensed day of operation.

G. Casino Nights: $100.00 for each occasion.

H. Bingo: $20.00 for each occasion.

I. Peddlers License: $125.00 plus an additional $50.00 for each vehicle used in connection therewith.

J. Taxi or limousine license: $20.00.

K. Assessment search: $10.00.

L. Alcohol Beverage Licenses:

1. Plenary retail consumption - $712.80.

2. Club - $188.00.

3. Plenary retail distribution - $296.40.

4. Limited retail distribution - $63.00.

5. Hotel/Motel - $594.00.

M. Public assembly license: $1,000.00 per day.

3. All ordinances or parts of ordinances or resolutions that are in conflict with the provisions of this Ordinance are repealed to the extent necessary.

4. If any article, section, subsection, term or condition of this Ordinance is declared invalid or illegal for any reason, the balance of the Ordinance shall be deemed severable and shall remain in full force and effect.

5. This Ordinance shall take effect after publication and passage according to law.

NOTICE

NOTICE IS HEREBY GIVEN that the above ordinance was introduced and passed on first reading at the Regular Meeting of the Township Council of the Township of Vernon in the County of Sussex, State of New Jersey held in the Municipal Building on October 2, 2006 and the same came up for final passage at the Regular Meeting of the Township Council held on October 23, 2006, at which time, after persons interested were given an opportunity to be heard concerning said ordinance, the same was passed and will be in full force in the Township according to law.
