ORDINANCE #06-12
AN ORDINANCE AMENDING THE VERNON TOWNSHIP ADMINISTRATIVE CODE TO ADD TO SECTIONS 330-5 AND SECTION 330-185 TO PROVIDE FOR THE CONSTRUCTION OF TWO-FAMILY DWELLINGS IN THE R-4 ZONE DISTRICT
BE IT ORDAINED by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows:
The following provisions shall be added to Section 330 of the Township Administrative Code:
“1. Section 330-5
A. The following new definition is added to Section 330-5. Definitions:
Dwelling, Two-Family – A building to be used as a residence designed for two (2) families having the exterior appearance of a single family dwelling house. Each unit in the duplex can be designed in a stacked or side by side configuration. Each dwelling unit has direct access to the outside.
2.Section 330-185
A. The following is added to Section 330-185. Supplemental regulations for certain permitted uses:
F. Two-family structures. Two-family structure developments provide opportunities for alternate housing for all income levels in the R-4 zone district and shall comply with the following requirements not withstanding any other provision of this chapter to the contrary:
1. Minimum tract area shall be 5 acres.
2. Maximum density shall be four units per acre.
3. Maximum number of units in a building shall be two.
4. Maximum building height shall be 40 feet or 3 stories
5. Minimum lot area shall be 10,000 square feet
6. Minimum lot width shall be 100 feet
7. Minimum lot depth shall be 100 feet
8. Minimum front yard setback shall be 30 feet (principal structures): 20 feet (front porch)
9. Side yard setback shall be 12 feet one side or 30 feet for both sides
10. Rear yard setback shall be 30 feet unless a garage is placed in the rear yard whereby the setback is reduced to 5 feet.
11. Maximum lot coverage shall be fifty (50%) percent.
12. Maximum building coverage shall be twenty (20%) percent.
13. Attached garage per structure (not per unit) shall contain no more than two (2) cars.
14. Parking requirement pursuant to Residential Site Improvement Standards (RSIS)”
2. The Township Clerk is hereby directed to give notice at least ten days prior to the adoption of this Ordinance to the County Planning Board and to all other persons entitled thereto pursuant to NJSA 40:55D-15 and NJSA 40:55D-63 (if required). Upon the adoption of this ordinance after public hearing thereon, the Township Clerk is further directed to publish notice of the passage thereof and to file a copy of the Ordinance as finally adopted with the Sussex County Planning Board as required by NJSA 40:55D-16. The Clerk shall also forthwith transmit a copy of this Ordinance after final passage to the Township Tax Assessor as required by NJSA 40:49-2.1.
3. All ordinances or parts of ordinances or resolutions that are in conflict with the provisions of this Ordinance are repealed to the extent necessary.
4. If any article, section, subsection, term or condition of this Ordinance is declared invalid or illegal for any reason, the balance of the Ordinance shall be deemed severable and shall remain in full force and effect.
5. This Ordinance shall take effect after publication and passage according to law.
NOTICE
NOTICE IS HEREBY GIVEN that the above ordinance was introduced and passed on first reading at the Regular Meeting of the Township Council of the Township of Vernon in the County of Sussex, State of New Jersey held in the Municipal Building on May 8, 2006 and the same came up for final passage at the Regular Meeting of the Township Council held on May 22, 2006, at which time, after persons interested were given an opportunity to be heard concerning said ordinance, the same was passed and will be in full force in the Township according to law.
