ORDINANCE #06-04
AN ORDINANCE AMENDING THE ADMINISTRATIVE CODE OF THE TOWNSHIP OF VERNON TO INCREASE ORDINANCE VIOLATION PENALTIES TO THE MAXIMUM PROVIDED BY STATE STATUTE
BE IT ORDAINED by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows:
1. The Administrative Code of the Township is hereby amended to provide that the maximum penalty for an ordinance violation shall be $2,000.00 for all violations for which there is a penalty provision in the Code and/or for any other Ordinance of the Township providing for violation penalties unless otherwise proscribed by law.
2. In such cases where a fine exceeding $1,250.00 is sought to be imposed for a housing or zoning violation, the defendant shall be provided a period of 30 days from the notice of violation or the summons to cure or abate the alleged violating condition and shall have the opportunity to appear before a Court of competent jurisdiction for a hearing on the issue. The Court may impose the higher fine after the 30 day period if the Court determines that the cure or abatement is not substantially complete.
3. All ordinances or parts of ordinances or resolutions that are in conflict with the provisions of this Ordinance are repealed to the extent necessary.
4. If any article, section, subsection, term or condition of this Ordinance is declared invalid or illegal for any reason, the balance of the Ordinance shall be deemed severable and shall remain in full force and effect.
5. This Ordinance shall take effect after publication and passage according to law.
NOTICE
NOTICE IS HEREBY GIVEN that the above ordinance was introduced and passed on first reading at the Regular Meeting of the Township Council of the Township of Vernon in the County of Sussex, State of New Jersey held in the Municipal Building on January 23, 2006 and the same came up for final passage at the Regular Meeting of the Township Council held on February 16, 2006, at which time, after persons interested were given an opportunity to be heard concerning said ordinance, the same was passed and will be in full force in the Township according to law.
