TOWNSHIP OF VERNON
ORDINANCE #06-03

AN ORDINANCE AMENDING ORDINANCE #05-21 AMENDING SCHEDULE B OF THE VERNON COMPREHENSIVE LAND DEVELOPMENT SUBCODE AND VACATING ORDINANCE #05-30

WHEREAS, the Township Council amended Schedule B of the Land Development Subcode by Ordinance #05-21 dated September 12, 2005 by which the Building Height for the TC (Town Center) Zone was changed to a maximum 2 stories and 30 feet; and

WHEREAS, the consultant engineer has further reviewed certain areas included in the TC zone and finds that the change was not necessary in certain areas based upon the current existence of non-compliant buildings in those areas and the nature of existing and proposed development in those areas.

NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows:

1. The requirements set forth in Schedule B, “Bulk and Yard Requirements”, of the Comprehensive Land Development Subcode for the TC zone are amended as follows for the Block and Lots set forth below as Schedule A and the amendment for said Blocks and Lots adopted by Ordinance #05-21 is hereby rescinded subject to the further provisions of this Ordinance.

Maximum Building Height (Ft/Stories) 40/3*

2. This change affects only those structures which meet the following conditions:

A. The ground floor is limited to under building parking of vehicles.

B. A blank or unarticulated wall is prohibited and the first level must be treated in such a manner as to be consistent with the remainder of the building. Inner pylons and columns may not be visible from the street.

C. Ground floor exterior walls must have architecturally appropriate design and cladding facing the street. They must blend with surrounding structures and continue the rhythm of storefronts and buildings along the street. They must compliment the scale and proportions of surrounding storefronts and building elevations.

D. A minimum of 40% of the façade must be solid and buildings on street visible stilts or columns are prohibited. 40% of the façade shall be mean of the entirety of the building, said percentage not being limited to the front of the building.

E. Architectural or landscape elements must be used to screen parked vehicles. It is the intention of this provision that parked vehicles under the building may not be visible from the street.

F. The entrance to under building parking shall be from the side of the building, an alley driveway or surface parking behind the building.

3. It is the intention of this exception to apply in such cases where there is limited sewer allocation, to lower impervious surface constraints or to improve the streetscape with taller building mass.

4. The Township Clerk is hereby directed to give notice at least ten days prior to the adoption of this Ordinance to the County Planning Board and to all other persons entitled thereto pursuant to NJSA 40:55D-15 and NJSA 40:55D-63 (if required). Upon the adoption of this ordinance after public hearing thereon, the Township Clerk is further directed to publish notice of the passage thereof and to file a copy of the Ordinance as finally adopted with the Sussex County Planning Board as required by NJSA 40:55D-16. The Clerk shall also forthwith transmit a copy of this Ordinance after final passage to the Township Tax Assessor as required by NJSA 40:49-2.1.

5. All ordinances, including Ordinance #05-30, or parts of ordinances or resolutions that are in conflict with the provisions of this Ordinance are repealed to the extent necessary.

6. If any article, section, subsection, term or condition of this Ordinance is declared invalid or illegal for any reason, the balance of the Ordinance shall be deemed severable and shall remain in full force and effect.

7. This Ordinance shall take effect after publication and passage according to law.

NOTICE

NOTICE IS HEREBY GIVEN that the above ordinance was introduced and passed on first reading at the Regular Meeting of the Township Council of the Township of Vernon in the County of Sussex, State of New Jersey held in the Municipal Building on January 9, 2006 and the same came up for final passage at the Regular Meeting of the Township Council held on January 23, 2006, at which time, after persons interested were given an opportunity to be heard concerning said ordinance, the same was passed and will be in full force in the Township according to law.
