OF VERNON
ORDINANCE #05-23
AN ORDINANCE ESTABLISHING THE TOWNSHIP OF VERNON PUBLIC
SANITARY SEWER SYSTEM AND THE TOWNSHIP OF VERNON MUNICIPAL
SEWER DEPARTMENT
WHEREAS, the Township of Vernon is engaged in the construction,
acquisition, development, operation and maintenance of
sanitary sewer facilities within the Township; and
WHEREAS,
it is the desire and intention of the Township Council
that all such sewage facilities be part of a single operating
system hereafter to be known as the Vernon Township Public
Sanitary Sewer System; and
WHEREAS,
it is the intention and desire of the Township Council
to administer said sewage facilities of the Vernon Township
Public Sanitary Sewer System, including all contractual
relationships relating to same, through a Municipal Department
of the Township Government, hereafter to be known as the
Vernon Municipal Sewer Department.
NOW,
THEREFORE, BE IT ORDAINED by the Township Council of the
Township of Vernon, County of Sussex and State of New
Jersey as follows:
1. There is hereby established the Vernon Township Public
Sanitary Sewer System which shall construct, acquire,
develop, operate and/or maintain all public sewer facilities
in the Township of Vernon.
2.
There is hereby established a Vernon Municipal Sewer Utility,
as same is defined in and subject to the provisions of
Title 40A of the New Jersey Statutes, which shall be a
Department of the Township Government known as the Vernon
Municipal Sewer Department and which shall administer
all functions of the Vernon Township Public Sanitary Sewer
System.
3.
All fees and charges received by the Township related
to the construction, acquisition, development, operation
and maintenance of the Vernon Township Public Sanitary
Sewer System shall be kept in a separate and distinct
fund from any other Township revenues for the sole purposes
of the Vernon Municipal Sewer Utility.
4.
All ordinances or parts of ordinances or resolutions that
are in conflict with the provisions of this Ordinance
are repealed to the extent necessary.
5.
If any article, section, subsection, term or condition
of this Ordinance is declared invalid or illegal for any
reason, the balance of the Ordinance shall be deemed severable
and shall remain in full force and effect.
6.
This Ordinance shall take effect after publication and
passage according to law.
NOTICE
NOTICE
IS HEREBY GIVEN that the above ordinance was introduced
and passed on first reading at the Regular Meeting of
the Township Council of the Township of Vernon in the
County of Sussex, State of New Jersey held in the Municipal
Building on September 12, 2005 and the same came up for
final passage at the Regular Meeting of the Township Council
held on September 26, 2005, at which time, after persons
interested were given an opportunity to be heard concerning
said ordinance, the same was passed and will be in full
force in the Township according to law.
