TOWNSHIP OF VERNON
ORDINANCE #05-13

AN ORDINANCE AMENDING ORDINANCE #01-23

BE IT ORDAINED by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows:

1. Revise Ordinance #01-23 to replace the word "resale" with "re-occupancy".

2. Revise Section 1. A fee of $55.00 per application is hereby established for the purpose of re-occupancy checklist review and inspection by Township personnel for all real property re-occupancy transactions in the Township of Vernon by sale, lease or otherwise. Said review and inspection to include property maintenance, compliance with Township ordinances and consistency of structure to tax assessor records and building department records. Commercial premises shall comply within 30 days of re-occupancy for the purpose of registering new businesses with the Vernon Police Department and Fire Prevention Office.

3. An additional fee in accordance with NJAC 5:70-2.9(d) shall be collected for the purpose of inspecting single and two family residential structures for smoke detector and carbon monoxide alarm compliance prior to re-occupancy as required by NJAC 5:70-2.3(a).

4. A penalty of $100 is hereby established for all premises other than one and two family residential homes that fail to comply with this ordinance. Said penalty shall be levied upon discovery of the violation.

5. All ordinances or parts of ordinances or resolutions that are in conflict with the provisions of this Ordinance are repealed to the extent necessary.

6. If any article, section, subsection, term or condition of this Ordinance is declared invalid or illegal for any reason, the balance of the Ordinance shall be deemed severable and shall remain in full force and effect.

7. This Ordinance shall take effect after publication and passage according to law.

NOTICE

NOTICE IS HEREBY GIVEN that the above ordinance was introduced and passed on first reading at the Regular Meeting of the Township Council of the Township of Vernon in the County of Sussex, State of New Jersey held in the Municipal Building on March 28, 2005 and the same came up for final passage at the Regular Meeting of the Township Council held on April 25, 2005, at which time, after persons interested were given an opportunity to be heard concerning said ordinance, the same was passed and will be in full force in the Township according to law.
