OF VERNON
ORDINANCE #04-32
AUTHORIZING THE ACQUISITION OF REAL PROPERTY LOCATED AT
BLOCK 20 ADJACENT TO LOT 22.02 AND AN ACCESS EASEMENTON
BLOCK 20 LOTS 22.02 THROUGH 22.11 IN THE TOWNSHIP OF VERNON,
COUNTY OF SUSSEX, STATE OF NEW JERSEY
WHEREAS, the Township Council of the Township of Vernon,
New Jersey has passed Resolution #03-127 authorizing the
Mayor and Clerk to execute the a Developers Agreement
with Glenwood Homes, Inc. and Newcastle Homes, LLC; and
WHEREAS,
said agreement provided that a private roadway adjacent
to Block 20 Lot 22.11 would be dedicated to Vernon as
an emergency access and that part of Block 20 Lots 22.02
through 22.11 would be dedicated to Vernon for an access
easement; and
WHEREAS,
this land will be used for a public purpose.
NOW, THEREFORE, BE IT ORDAINED by the Township Council
of Vernon, County of Sussex and State of New Jersey as
follows:
1. The acquisition of part of Block 20 Lot 22.11 as set
forth on the metes and bounds description and part of
Block 20 Lots 222.02 through 22.11, which property is
located in Vernon, Sussex County, New Jersey is approved
as set forth in the Developers Agreement dated August
2003. This approval is pursuant to NJSA 40A:12-1 et seq.
2.
The real property being acquired is to be used for a public
purpose.
3.
All ordinances or parts of ordinances or resolutions that
are in conflict with the provisions of this Ordinance
are repealed to the extent necessary.
4. If any article, section, subsection, term or condition
of this Ordinance is declared invalid or illegal for any
reason, the balance of the Ordinance shall be deemed severable
and shall remain in full force and effect.
5.
This Ordinance shall take effect after publication and
passage according to law.
NOTICE
NOTICE
IS HEREBY GIVEN that the above ordinance was introduced
and passed on first reading at the Regular Meeting of
the Township Council of the Township of Vernon in the
County of Sussex, State of New Jersey held in the Municipal
Building on September 27, 2004 and the same came up for
final passage at the Regular Meeting of the Township Council
held on October 14, 2004, at which time, after persons
interested were given an opportunity to be heard concerning
said ordinance, the same was passed and will be in full
force in the Township according to law.
