TOWNSHIP OF VERNON
ORDINANCE #04-30

AN ORDINANCE TO AMEND AND SUPPLEMENT THE COMPREHENSIVE LAND DEVELOPMENT SUBCODE, AUTHORIZE ZONING DISTRICT CHANGES TO CERTAIN PROPERTIES AND CHANGES TO THE ZONING MAP OF THE TOWNSHIP OF VERNON.

Whereas, the Township Council has reviewed the attached recommendations of the Planning Board and requested changes to the zoning map of the Township of Vernon; and

Whereas, the proposed zoning changes have been recommended by the Township Planning Board and professional staff to provide for residential growth at lower densities to protect ground water quality, steep slopes, scenic vistas and to avoid intrusive land use near wetland and buffer areas. Further, the zoning changes significantly lessen the amount of future population in the environs and promote concentrated mixed use activities in the town center zone district; and

Whereas, the Township Planning Board held a public hearing on October 22, 2003 and July 14, 2004 on the proposed land use changes to the Land Use Plan of the Township Master Plan; and

Whereas, the Township Planning Board approved the changes, as modified, to the Land Use Plan of the Township Master Plan at the November 12, 2003 and October 13, 2004 meetings; and

Whereas, the Township Council has determined to act favorably upon the requested changes; and

Now, Therefore, based upon the recommendations of the Planning Board of the Township of Vernon:

Be It Ordained by the Township Council of the Township of Vernon, County of Sussex, State of New Jersey, that the Official Zoning Map of the Township of Vernon is amended as follows:

1. The following Blocks and Lots shall be rezoned from the current R-2 (Residential Low Density) to R-1 (Residential Rural Density) zone designation.

11.  Exhibit “A” (attached) titled “Land Development Subcode-Schedule B: Bulk and Yard Requirements” is revised dated October 13, 2004.

12.   Article 7: Design and Development Priorities and Standards - New Section 729 entitled “Flag Lots.  Flag Lots are prohibited in all residential zones.”

13.  If any section of provision hereof shall be adjudged invalid or illegal, such determination shall not affect the other provisions hereof which shall remain in full force and effect.

14.  All ordinances or parts of ordinances or resolutions that are inconsistent with the provisions of this Ordinance are repealed to the extent of such inconsistency.

15.  The Township Clerk is hereby directed to give notice at least ten days prior to the adoption of this Ordinance to the County Planning Board and to all other persons entitled thereto pursuant to NJSA 40:55D-15 and NJSA 40:55D-63 (if required).

16.  The ordinance shall take effect after publication and passage according to law.

NOTICE

NOTICE IS HEREBY GIVEN that the above ordinance was introduced and passed on first reading at the Regular Meeting of the Township Council of the Township of Vernon in the County of Sussex, State of New Jersey held in the Municipal Building on November 22, 2004 and the same came up for final passage at the Regular Meeting of the Township Council held on December 13, 2004, at which time the following corrections were made to Schedule A: Revised October "13", 2004; "Maximum" Building Height; "Maximum" Lot Coverage. After persons interested were given an opportunity to be heard concerning said ordinance, the same was passed and will be in full force in the Township according to law.
