VERNON
TOWNSHIP ORDINANCE #03-42
AN ORDINANCE ESTABLISHING AN ADVISORY BOARD OF HEALTH
IN THE TOWNSHIP OF VERNON, NEW JERSEY PURSUANT TO NJSA
26:3-10
WHEREAS,
the Township Council presently acts as the Township Board
of Health; and
WHEREAS,
the Township Council has determined that it is appropriate
to establish a separate advisory Board of Health pursuant
to NJSA 26:3-10.
NOW,
THEREFORE, BE IT ORDAINED by the Township Council of the
Township of Vernon, County of Sussex and State of New
Jersey as follows:
1.
The Council hereby establishes an advisory Board of Health
for the Township of Vernon, the purpose of which is to
provide advice and counsel to the Township Council on
matters and issues relating to health, safety and welfare
of Vernon residents and issues of health policy for the
Township and to perform such functions related to public
health issues as shall be lawfully requested of the Board
by the Township Council or Township Manager.
2. The Board of Health shall be composed of five residents
of the Township of Vernon (except as provided in NJSA
26:3-10) or Township employees, who may or may not be
residents, to be appointed by the Township Manager. The
terms of appointment shall be for four years except that
two of the originally appointed members shall serve for
an initial three year term, said members to be determined
by the Township Manager. Vacancies shall be appointed
as per NJSA 26:3-16. The Township Manager shall make every
effort to appoint either a Nurse or the Township Physician
to the Board of Health, subject to the consent provision
of NJSA 26:3-10. The Township Manager shall appoint a
Chairperson of the Board of Health who shall preside at
the meetings, but who shall have no greater power than
other members, before the first meeting of the Board for
each year.

The Board of Health shall comply with the meeting requirements
of and shall meet for the purposes established by NJSA
26:3-12. The Board of Health shall adopt by-laws, rules
or regulations for the governance of the Board not inconsistent
with the law or the State sanitary code. The Board of
Health shall not have the authority to adopt Ordinances
or make Township policy, which shall remain under the
authority of the Township Council.
4.
Appeals from issues arising before the Health Department
shall be heard by the Township Council, in its sole discretion.
In such instances where the Council elects not to hear
such appeal, nothing herein shall be construed to deny
any and all legal and equitable rights now or hereafter
in existence to an appellant.
5. Members of the board of Health shall be compensated
as required by NJSA 26:3-13.
6. All ordinances or parts of ordinances or resolutions
that are in conflict with the provisions of this Ordinance
are repealed to the extent necessary.
7. If any article, section, subsection, term or condition
of this Ordinance is declared invalid or illegal for any
reason, the balance of the Ordinance shall be deemed severable
and shall remain in full force and effect.
8.
This Ordinance shall take effect after publication and
passage according to law.

NOTICE
IS HEREBY GIVEN that the above ordinance was introduced
and passed on first reading at the Regular Meeting of
the Township Council of the Township of Vernon in the
County of Sussex, State of New Jersey held in the Municipal
Building on November 10, 2003 and the same came up for
final passage at the Regular Meeting of the Township Council
held on November 24, 2003, at which time, after persons
interested were given an opportunity to be heard concerning
said ordinance, the same was passed and will be in full
force in the Township according to law.
