VERNON
TOWNSHIP ORDINANCE #03-40
AUTHORIZING THE ACQUISITION OF REAL PROPERTY LOCATED AT
PART OF BLOCK 144 LOTS 32 AND 32.01 IN THE TOWNSHIP OF
VERNON, COUNTY OF SUSSEX, STATE OF NEW JERSEY AS SET FORTH
IN THE CONTRACT TO PURCHASE ATTACHED HERETO AND MADE A
PART HEREOF
WHEREAS,
the Township Council of the Township of Vernon, New Jersey
has passed Resolution #03-135 authorizing the Mayor and
Clerk to execute the attached contract for the acquisition
of real property from the Vernon Township Fire Department
#1 pursuant to NJSA 40A:12-1 et seq; and
WHEREAS,
this land will be used for the public purpose of the construction,
utilization and maintenance of a municipal road and related
facilities.
NOW,
THEREFORE, BE IT ORDAINED by the Township Council of Vernon,
County of Sussex and State of New Jersey as follows:
1. The acquisition of part of Block 144 Lots 32 and 32.01
set forth on the metes and bounds description, which property
is located in Vernon, Sussex County, New Jersey is approved
as set forth in the Contract, attached hereto and made
a part hereof. This approval is pursuant to NJSA 40A:12-1
et seq.
2. The real property being acquired is to be used for
the public purpose of constructing, utilizing and maintaining
a municipal road and related facilities.
3.
All ordinances or parts of ordinances or resolutions that
are in conflict with the provisions of this Ordinance
are repealed to the extent necessary.
4. If any article, section, subsection, term or condition
of this Ordinance is declared invalid or illegal for any
reason, the balance of the Ordinance shall be deemed severable
and shall remain in full force and effect.
5. This Ordinance shall take effect after publication
and passage according to law.
NOTICE
NOTICE
IS HEREBY GIVEN that the above ordinance was introduced
and passed on first reading at the Regular Meeting of
the Township Council of the Township of Vernon in the
County of Sussex, State of New Jersey held in the Municipal
Building on November 10, 2003 and the same came up for
final passage at the Regular Meeting of the Township Council
held on November 24, 2003, at which time, after persons
interested were given an opportunity to be heard concerning
said ordinance, the same was passed and will be in full
force in the Township according to law.
