VERNON
TOWNSHIP ORDINANCE #03-38
AN ORDINANCE AMENDING, IN PART, ORDINANCE #84-13 AND ESTABLISHING
FINES FOR HANDICAP PARKING VIOLATIONS
WHEREAS
Chapter 16, Public Laws of 2003 has been amended to provide
for an increase in fines for parking in a restricted parking
space reserved for handicapped individuals effective October
1, 2003; and
WHEREAS, the Township of Vernon seeks to implement said
increased fines; and
WHEREAS,
if Summonses for violations for parking in a handicap
parking space are cited to the Ordinance, said fines are
payable to the Township of Vernon, which will offset court
costs and police efforts to enforce compliance.
NOW,
THEREFORE, BE IT ORDAINED by the Township Council of the
Township of Vernon, County of Sussex and State of New
Jersey as follows:
1. Fines for Parking in a Handicapped Parking Space without
legal authority from the Director of the Division of Motor
Vehicles shall be as follows:
A. For a first offense, $250.00.
B. For a second or subsequent offense, $250.00 and a
period of community service not to exceed 90 days.
2.
All signs designating such parking shall be amended to
reflect the penalties set forth herein.
3. All ordinances or parts of ordinances or resolutions
that are in conflict with the provisions of this Ordinance
are repealed to the extent necessary.
4. If any article, section, subsection, term or condition
of this Ordinance is declared invalid or illegal for any
reason, the balance of the Ordinance shall be deemed severable
and shall remain in full force and effect.
5. This Ordinance shall take effect after publication
and passage according to law.
NOTICE
NOTICE
IS HEREBY GIVEN that the above ordinance was introduced
and passed on first reading at the Regular Meeting of
the township Council of the Township of Vernon in the
County of Sussex, State of New Jersey held in the Municipal
Building on October 6, 2003 and the same came up for final
passage at the Regular Meeting of the Township Council
held on November 10, 2003, at which time, after persons
interested were given an opportunity to be heard concerning
said ordinance, the same was passed and will be in full
force in the Township according to law.
