VERNON
TOWNSHIP ORDINANCE #03-35
AN ORDINANCE AMENDING ORDINANCES #02-28 AND #03-18 WHICH
PROVIDE FOR TOWN CENTER ROADWAY CONTRIBUTIONS
BE
IT ORDAINED by the Township Council of the Township of
Vernon, County of Sussex and State of New Jersey as follows:
1. Paragraph i of Article 9, Section 901C(2) B(5), as
created by Ordinance #02-28 and as previously amended
by Ordinance #03-18, shall be replaced with the following
language:
"i. All development on properties located within the following
zone districts: the entire Town Center (TC); that portion
of Office Professional (C-3) adjacent to Route 94; that
portion of Commercial Recreation (CR) adjacent to Route
94; and that portion of General Business/Shopping Center
(C-2) adjacent to and north of Route 94, as shown on the
attached map entitled "Portion of Zone Map Showing Town
Center Traffic Control Improvement Area", shall be required
to make a pro-rata contribution to Town Center improvements
to be determined by the Planning Board or Zoning Board
of Adjustment, as the case may be, at the time of either
general development plan, preliminary or final approval
of an application for development. The MSCD overlay zone
created by Ordinance #03-18 shall remain in full force
and effect."
2.
The Township Clerk is hereby directed to give notice at
least ten days prior to the adoption of this Ordinance
to the County Planning Board and to all other persons
entitled thereto pursuant to NJSA 40:55D-15 and NJSA 40:55D-63
(if required). Upon the adoption of this ordinance after
public hearing thereon, the Township Clerk is further
directed to publish notice of the passage thereof and
to file a copy of the Ordinance as finally adopted with
the Sussex County Planning Board as required by NJSA 40:55D-16.
The Clerk shall also forthwith transmit a copy of this
Ordinance after final passage to the Township Tax Assessor
as required by NJSA 40:49-2.1.
3. All ordinances or parts of ordinances or resolutions
that are in conflict with the provisions of this Ordinance
are repealed to the extent necessary.
4. If any article, section, subsection, term or condition
of this Ordinance is declared invalid or illegal for any
reason, the balance of the Ordinance shall be deemed severable
and shall remain in full force and effect.
5. This Ordinance shall take effect after publication
and passage according to law.
NOTICE
NOTICE
IS HEREBY GIVEN that the above ordinance was introduced
and passed on first reading at the Regular Meeting of
the Township Council of the Township of Vernon in the
County of Sussex, State of New Jersey held in the Municipal
Building on September 8, 2003 and the same came up for
final passage at the Regular Meeting of the Township Council
held on September 22, 2003, at which time, after persons
interested were given an opportunity to be heard concerning
said ordinance, the same was passed and will be in full
force in the Township according to law.
