VERNON TOWNSHIP ORDINANCE #03-25

AN ORDINANCE AMENDING S1152 OF THE TOWNSHIP OF VERNON, NJ COMPREHENSIVE LAND DEVELOPMENT SUBCODE

Whereas, the Vernon Township Council recognizes the importance of maintaining an effective and reasonable Comprehensive Land Development Subcode which does not create an unnecessary burden or hardship on Vernon Township residents and businesses who are desirous of keeping certain vehicles on their property; and

Whereas, the Vernon Township Council, in an effort to provide clarification to existing S1152 of the Comprehensive Land Development Subcode and reduce problems stemming from the parking of commercial vehicles and school buses on properties in the township, is desirous of allowing an exception which would permit the parking of certain vehicles on large lots and farm properties where adequate screening from adjoining properties can be reasonably maintained.

Now, Therefore, Be It Ordained by the Township Council of Vernon, County of Sussex and State of New Jersey that S1152 of the Comprehensive Land Development Subcode shall be amended to read as follows in Paragraph 1 of this Ordinance:

1. Commercial vehicles in residential districts. Not more than one (1) commercial vehicle shall be parked on a lot used for residential purposes. Such vehicle shall be owned, leased or regularly operated by a resident of the premises, or if not the resident, then on property that is at least six (6) acres in size, and said vehicle shall be limited to vehicles which are no more than 26' in length and have a GVW rating of 17,500, or is a school bus, and this provision shall not be construed to limit the number and type of commercial vehicles in use on a farm and in connection with farming operations conducted on the property.

2. The Township Clerk is hereby directed to give notice at least ten days prior to the adoption of this Ordinance to the County Planning Board and to all other persons entitled thereto pursuant to NJSA 40:55D-15 and NJSA 40:55D-63 (if required). Upon the adoption of this ordinance after public hearing thereon, the Township Clerk is further directed to publish notice of the passage thereof and to file a copy of the Ordinance as finally adopted with the Sussex County Planning Board as required by NJSA 40:55D-16. The Clerk shall also forthwith transmit a copy of this Ordinance after final passage to the Township Tax Assessor as required by NJSA 40:49-2.1.

3. All ordinances or parts of ordinances or resolutions that are in conflict with the provisions of this Ordinance are repealed to the extent necessary.

4. If any article, section, subsection, term or condition of this Ordinance is declared invalid or illegal for any reason, the balance of the Ordinance shall be deemed severable and shall remain in full force and effect.

5. This Ordinance shall take effect after publication and passage according to law.

NOTICE

NOTICE IS HEREBY GIVEN that the above ordinance was introduced and passed on first reading at the Regular Meeting of the Township Council of the Township of Vernon in the County of Sussex, State of New Jersey held in the Municipal Building on July 14, 2003 and the same came up for final passage at the Regular Meeting of the Township Council held on July 28, 2003, at which time, after persons interested were given an opportunity to be heard concerning said ordinance, the same was passed and will be in full force in the Township according to law.
