VERNON
TOWNSHIP ORDINANCE #03-20
AN ORDINANCE TO ACCEPT THE DEDICATION OF A DRAINAGE EASEMENT
FROM WILLIAM AND MARION VAN ALTHUIS AS FURTHER DESCRIBED
HEREIN AND PURSUANT TO THE TERMS AND CONDITIONS OF THIS
ORDINANCE
WHEREAS,
William and Marion Van Althuis are required to provide
a drainage easement pursuant to a condition of approval
from the Township Planning Board; and
WHEREAS,
the Township Council of the Township of Vernon is desirous
of obtaining said drainage easement pursuant to the Planning
Board approval; and
WHEREAS, the Township of Vernon does hereby determine
to accept said dedication of the within drainage easement
as set forth herein for the benefit of the Township of
Vernon and the public in general.
NOW,
THEREFORE, BE IT ORDAINED by the Township Council of the
Township of Vernon, County of Sussex and State of New
Jersey as follows:
1.
The drainage easement set forth in the attached easement
of dedication, being part of Block 22.02 Lot 5, is hereby
accepted as and for a public drainage easement, pursuant
to the final planning board approval.
2.
The Township Attorney is authorized and directed to accept
the Drainage Easement and to record same for the benefit
of the Township.
3.
If any article, section, subsection, term or condition
of this Ordinance is declared invalid or illegal for any
reason, the balance of the Ordinance shall be deemed severable
and shall remain in full force and effect.
4.
All ordinances or parts of ordinances or resolutions that
are in conflict with the provisions of this Ordinance
are repealed to the extent necessary.
5. This Ordinance shall take effect after publication
and passage according to law.
NOTICE
NOTICE
IS HEREBY GIVEN that the above ordinance was introduced
and passed on first reading at the Regular Meeting of
the Township Council of the Township of Vernon in the
County of Sussex, State of New Jersey held in the Municipal
Building on June 9, 2003 and the same came up for final
passage at the Regular Meeting of the Township Council
held on June 23, 2003, at which time, after persons interested
were given an opportunity to be heard concerning said
ordinance, the same was passed and will be in full force
in the Township according to law.
