TOWNSHIP ORDINANCE #03-18
AN ORDINANCE TO AMEND THE LAND DEVELOPMENT SUBCODE OF
THE TOWNSHIP OF VERNON TO PROVIDE FOR TOWN CENTER ROADWAY
CONTRIBUTIONS
BE
IT ORDAINED by the Township of Vernon, County of Sussex,
and State of New Jersey as follows:
Section
1. The Land Development Subcode of the Township of Vernon,
Article 9-Section 901C(2) B (5) is amended as follows:
Add
the following paragraph to the end of paragraph i:
In addition to the zone districts hereinabove referenced,
there shall be created in the TC Zone a new Vernon Town
Center Main Street Core District (MSCD) as an overlay
zone which shall require a separate pro-rata contribution.
Existing
paragraph ii shall be renumbered as ii.a.
Add new paragraph ii.b. as follows:
Schedule F, Vernon Town Center Main Street Core District,
Fair Share Contribution, is incorporated herein and attached
hereto. The pro-rata shares as shown shall apply only
in the Vernon Town Center Main Street Core District (MSCD).
In the MSCD the developer shall pay his pro-rata share
based on the square footage cost rates for the respective
land use proposed as listed in Schedule F, Item C. The
Township Engineer shall make recommendations to the Governing
Body with reference to any adjustments to be made in the
estimates of land use areas or traffic rates in Schedule
F, from time to time, which estimates may be amended by
resolution of the Governing Body. Any such resolution
shall be provided to the Planning Board, Zoning Board
of Adjustment, and any subsequent application for development
on properties which are subject to this provision.
NOTICE
NOTICE
IS HEREBY GIVEN that the above ordinance was introduced
and passed on first reading at the Regular Meeting of
the Township Council of the Township of Vernon in the
County of Sussex, State of New Jersey held in the Municipal
Building on April 28, 2003 and the same came up for final
passage at the Regular Meeting of the Township Council
held on June 9, 2003, at which time, after persons interested
were given an opportunity to be heard concerning said
ordinance, the same was passed and will be in full force
in the Township according to law.
