VERNON TOWNSHIP ORDINANCE #03-09

AN AMENDMENT TO THE CODE OF THE TOWNSHIP OF VERNON, COUNTY OF SUSSEX, STATE OF NEW JERSEY, BY AMENDING ARTICLE IX - SPEED LIMITS, 99-41 BY CHANGING THE SPEED LIMIT OF A PORTION OF WAWAYANDA ROAD

WHEREAS, the Township Engineer has certified to the Township Council, pursuant to NJSA 39:4-8 that the Engineer has investigated the traffic circumstances on the roadway in question, that it appears to the Engineer that it is in the interest of the public safety and the expedition of traffic that the speed limit be lowered and that the installation of markings will conform to the standards of the Manual of Uniform Traffic Control Devices for Streets and Highways; and

WHEREAS, the roadway in question is wholly contained in the Township of Vernon.

NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows:

Section 1. That the speed limits for both directions of traffic along Wawayanda Road, where indicated below, be changed by amending 99-41 as follows:

between Barry Drive No. and the Wawayanda State Park entrance/exit

Section 2. Regulatory and Warning signs shall be erected and maintained to affect the above designated speed limit, subject to invalidation by the Commissioner of the Department of Transportation.

Section 3. A certified copy of this Ordinance shall be transmitted to the Commissioner of the Department of Transportation within thirty days of final adoption as required by law, along with the Engineer's certification, a statement of reasons by the Engineer, detailed information as to the location of streets, intersections and signs affected by the erection and placement of signs and a traffic count, accident and speed sampling if appropriate.

Section 4. This ordinance shall take effect upon adoption according to law and subject to the invalidation of same by the Commissioner of the Department of Transportation pursuant to NJSA 39:4-8.

Section 5. Repealer. Any and all ordinances or parts thereof inconsistent with the provisions of this ordinance are hereby repealed to such extent as they are so in conflict or inconsistent, provided, however, that the adoption of this ordinance shall not prevent or bar the continuance or institution of any proceedings for offenses heretofore committed in violation of any existing ordinances of the Township of Vernon.

Section 6. Severability. Should any section, paragraph, sentence, clause or phrase of this ordinance be declared unconstitutional or invalid for any reason, the remaining portions of this ordinance shall not be affected thereby and shall remain in full force and effect, and to this and the provisions of this ordinance are hereby declared severable.

NOTICE

NOTICE IS HEREBY GIVEN that the above ordinance was introduced and passed on first reading at the Regular Meeting of the Township Council of the Township of Vernon in the County of Sussex, State of New Jersey held in the Municipal Building on March 24, 2003 and the same came up for final passage at the Regular Meeting of the Township Council held on April 14, 2003, at which time, after persons interested were given an opportunity to be heard concerning said ordinance, the same was passed and will be in full force in the Township according to law.
