VERNON TOWNSHIP ORDINANCE #03-03

AN ORDINANCE AMENDING ORDINANCE #02-32 WHICH ESTABLISHED A DEDICATED BY RIDER TRUST FUND, ASSOCIATED FEES AND PROCEDURES FOR COLLECTION AND PAYMENT OF FUNDS TO POLICE OFFICERS FOR PRIVATE OFF-DUTY EMPLOYMENT

WHEREAS, the Township of Vernon permits regular police officers and special police officers to perform services and off duty services, for public health, safety and welfare, for private persons and entities; and

WHEREAS, the Township is required to comply with the Fair Labor Standards Act, State of New Jersey budgeting law, State case law and the Attorney General opinions; and

WHEREAS, the Township is permitted to recoup costs by establishing fees by Ordinance for the employer social security, additional insurance, administrative costs of maintaining time records, payroll processing and billing vendors; and

WHEREAS, the rate to be paid to police officers for off duty services is established by collective bargaining and is included in the PBA collective bargaining agreement; and

WHEREAS, the rate to be paid to special police officers is determined by the Township for private persons and entities.

NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows.

1. The Chief Financial Officer is hereby authorized and directed to establish such Dedicated by Rider Trust Funds as are required to provide for escrows for funds to be paid to off duty police officers and special police officers as and for payment for duties so performed under the terms of the collective bargaining agreement by and between the Township and the PBA for regular police officers or separate agreement for special police officers.

2. A fee is hereby established in the amount of $6.00 to be paid to the Township for each hour of off duty work performed by police officers for private persons and entities. Said amount is presently established as follows: employer social security (7.65%); workers compensation insurance (3.12%); and administrative costs representing the balance. The fee for special police officers is $2.75 per hour.

3. Estimated funds to be used for off duty work of police officers or for special police officers must be paid by the private persons or entities and escrowed pursuant to this Ordinance prior to the utilization of the off duty police officer or special officer. Such estimated amount shall be established by the Chief of Police and the Chief Financial Officer or designee. Excess funds shall be promptly returned to the private person or entity after performance of all work or off duty work and submission of required paperwork. If funds are not available in escrow, special police officer work or regular police officer off duty work will not be permitted.

4. All ordinances or parts of ordinances or resolutions that are in conflict with the provisions of this Ordinance are repealed to the extent necessary.

5. If any article, section, subsection, term or condition of this ordinance is declared invalid or illegal for any reason, the balance of the Ordinance shall be deemed severable and shall remain in full force and effect.

6. This ordinance shall take effect after publication and passage according to law.

NOTICE

NOTICE IS HEREBY GIVEN that the above ordinance was introduced and passed on first reading at the Regular Meeting of the Township Council of the Township of Vernon in the County of Sussex, State of New Jersey held in the Municipal Building on January 27, 2003 and the same came up for final passage at the Regular Meeting of the Township Council held on February 10, 2003, at which time, after persons interested were given an opportunity to be heard concerning said ordinance, the same was passed and will be in full force in the Township according to law.
