An Ordinance to Refer the Revocation of the Historic Designation Granted to the Property Known as Block 144.01, Lot 7 (Formerly Block 144, Lot 31) and the Amendment of the Master Plan to the Vernon Township Land Use Board

WHEREAS, on September 10, 2009, the Township Council of the Township of Vernon (“Township”) passed Ordinance No. 09-14 which granted the property known as Block 144.01, Lot 7 (formerly Block 144, Lot 31) (“Property”) with a municipal historic designation; and

WHEREAS, Ordinance No. 09-14 also required that the Property be included in the Historic Element of the Master Plan; and

WHEREAS, the Township has determined that it may be in the best interest of the municipality to revoke the historic designation granted to the property to assist with the disposition of the Property; and

WHEREAS, pursuant to N.J.S.A. 40:55-26, a governing body is permitted to refer matters by ordinance to the planning board for consideration; and

WHEREAS, the Township’s Planning Board and Board of Adjustment have been combined into one Land Use Board; and

NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Vernon, County of Sussex, and State of New Jersey as follows:

  1. The Vernon Township Land Use Board shall consider the revocation of the historic designation granted to the property located at Block 144.01, Lot 7 (formerly Block 144, Lot 31) and shall further assess its removal from the Historic Element of the Master Plan.
  2. The Land Use Board shall further conduct all hearings, make all public notifications, and provide its recommendations to the Township Council as required by state law.
  3. The Township Clerk shall forward this Ordinance to the Land Use Board upon final adoption.
  4. A copy of this Ordinance shall be kept on file with the Township Clerk.

INCONSISTENCY: Any ordinances or parts thereof in conflict with the provisions of this Ordinance are hereby repealed as to their inconsistencies only.

EFFECTIVE DATE: This Ordinance shall take effect immediately as provided by law.
