An Ordinance of the Township of Vernon, County of Sussex, State of New Jersey Amending §99-25 of the Vernon Township Code and Allowing Only Resident Permit Parking on Carol Drive, Old Glenwood Circle, Meadowlark Drive, Cove Court, Vlietstra Drive, Thistle Avenue, Ivy Place and Ann Place and Designating Parking Areas along CR 517

WHEREAS, the Appalachian Trail is located in Vernon Township; and

WHEREAS, individuals are able to access the Appalachian Trial in Vernon Township; and

WHEREAS, the Township of Vernon has experienced congested and unsafe parking of vehicles on Carol Drive, Old Glenwood Circle, Meadowlark Drive, Cove Court, Vlietstra Drive, Thistle Avenue, Ivy Place, Ann Place and CR 517 by individuals accessing the Appalachian Trail; and

WHEREAS, the Township of Vernon has determined that limiting parking to residents of Carol Drive, Old Glenwood Circle, Meadowlark Drive, Cove Court, Vlietstra Drive, Thistle Avenue, Ivy Place and Ann Place is necessary for the safety and quality of life for the residents in this area; and

NOW THEREFORE BE IT ORDAINED that the Township of Vernon hereby amends Chapter 99 of its Township Code to provide as follows:

Section 25. Section 25 of the Vernon Township Code shall be amended to include the following provisions.

Section 25.1. Appalachian Trail Residential Permit Parking Area

  1. Defined. The Mayor and Council of the Township of Vernon have determined that there is an acute problem or potential problems for providing safe, on-street parking on Carol Drive, Old Glenwood Circle, Meadowlark Drive, Cove Court, Vlietstra Drive, Thistle Avenue, Ivy Place, Ann Place and CR 517. The Mayor and Council have, therefore, determined that the greater public interest will be served by insuring convenient and reasonable access to homes and that the following limitations on parking will promote such an interest.
  2. Designation of Appalachian Trail Residential Permit Parking Area. Parking shall be prohibited on streets in the Appalachian Trail Residential Permit Parking Area, except to vehicles that display a parking permit issued by the Vernon Township Police Department pursuant to this section of the Township Code (“Appalachian Trail Resident Parking Permit”). The Appalachian Trail Permit Parking Area shall include:
    1. Carol Drive
    2. Old Glenwood Circle
    3. Meadowlark Drive
    4. Cove Court
    5. Vlietstra Drive
    6. Thistle Avenue
    7. Ivy Place
    8. Ann Place
  3. Permit Types. Resident Parking Permits. Residents who live in the Appalachian Trail Residential Permit Parking Area are eligible for a permit that allows the resident or their guest to park a vehicle on a road within the Appalachian Trail Residential Permit Parking Area. An Appalachian Trail Resident Parking Permit is nontransferable and shall be valid for up to 365 days from the date the permit is issued. An Appalachian Trail Resident Parking Permit must be surrendered to the Vernon Township Police Department immediately if the person to whom the permit(s) was issued no longer resides within the Appalachian Trail Residential Permit Parking Area.
  4. Permit Applications. Permits shall only be issued to homeowners or tenants within the Appalachian Trail Residential Permit Parking Area or persons leasing a home within the Appalachian Trail Residential Permit Parking Area. To obtain an Appalachian Trail Resident Parking Permit, a home owner or tenant shall present proof of ownership or residency, such as a lease agreement, tax bill or utility bill, to the Vernon Township Police Department confirming said residency. Upon the presentation of proof of residency, up to five (5) Appalachian Trail Resident Parking Permits will be issued for no fee. The Vernon Township Police Department may issue more than five (5) permits, upon a resident showing good cause for issuance of additional permits.
  5. Display of Permit. Upon the issuance of an Appalachian Trail Resident Parking Permit, the resident or guest will display the permit in the windshield of their vehicle so it can be easily observed by the Vernon Township Police Department.
  6. Restrictions and Penalties. All vehicles parked within the Appalachian Trail Residential Permit Parking Area shall comply with Title 39 of the statutes of the State of New Jersey. Any violation of this section of the Township Code shall be subject to a fine of $100.00.
  7. Designation of areas that do not require permits. Vehicles may be parked at the following areas of CR 517 and permits are not required to park at these locations:
    1. CR 517 northbound shoulder, north of Meadowlark Drive and south of Carol Drive as marked by signage.
    2. CR 517 southbound shoulder, north of Carol Drive for a distance of 1050 feet, as marked by signage.
    3. Parking is prohibited on any other area of CR 517 between Vlietstra Drive and Ann Place.
    4. All vehicles parked within the above listed areas shall comply with Title 39 of the statutes of the State of New Jersey.

The provisions of this Ordinance shall be applicable within Vernon Township upon final adoption and shall become part of the Vernon Township Code once completed and adopted.
