An ordinance of the Township of Vernon, County of Sussex, and State of New Jersey accepting deed of right of way dedication for a portion of property designated as Block 194.05, Lot 14 located along Mountain Trail and Meadow Lane

WHEREAS, Philip and Donna Girlando (“Applicants”) are the owners of vacant land in the Township of Vernon (“Township”), County of Sussex and State of New Jersey designated as Block 194.05, Lot 14 on the Official Tax Maps of the Township of Vernon (“Township”), more commonly known as 13-21 Mountain Trail (“Property”); and

WHEREAS, the Applicants previously submitted a land use application identified as LU9-15-11 to Vernon Township Land Use Board (“Board”) seeking minor subdivision approval for the Property; and

WHEREAS, on October 28, 2015 the Board memorialized the grant of minor subdivision approval to the Applicants for the Property; and

WHEREAS, as a condition of approval, the Applicants agreed to grant a Right of Way, in perpetuity, to the Township for travel and maintenance of the public roadway now designated as Meadow Lane, as set forth in the metes and bounds description contained in the Deed attached hereto as Exhibit A; and

WHEREAS, the Deed has been reviewed and approved by the Township Engineer and Board Attorney; and

WHEREAS, the Township Council deems it to be in the best interest of the Township to formally accept the Deed of Dedication of Right of Way for Meadow Lane.

NOW THEREFORE, BE IT ORDAINED, by the Township Council of the Township of Vernon, in the County of Sussex, and State of New Jersey, as follows:

  1. The Deed of Dedication of Right-of-Way attached hereto as Exhibit A from Philip and Donna Girlando to the Township for a portion of the property designated as Block 194.05, Lot 14 on the Official Tax Maps of the Township of Vernon Township, is hereby accepted by the Township of Vernon.
  2. In the event of any inconsistencies between the provisions of this Ordinance and any prior ordinance of the Township, the provisions hereof shall be determined to govern. All other ordinances of the Township are hereby ratified and confirmed, except where inconsistent with the terms hereof.
  3. If any article, section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this Ordinance and they shall remain in full force and effect.
  4. This Ordinance shall take effect immediately upon final passage and publication according to law.
