An ordinance to provide and determine the salary for the mayor of the Township of Vernon
Note: Ordinance suspended based on referendum, failed on ballot.
WHEREAS, N.J.S.A. 40A:9-165 permits a municipality to establish salaries, wages and compensation to be paid to its officers and employees; and
WHEREAS, all of the executive and administrative powers of Vernon Township are exercised by its Mayor subject to the procedures set forth in the Mayor-Council Plan of government under N.J.S.A. 40:69A-39; and
WHEREAS, the exercise of all executive and administrative functions of the Township are the responsibility of the Mayor pursuant to the Code of Vernon Township; and
WHEREAS, Section 5-3 of the Vernon Township Code requires that the Mayor’s executive and administrative responsibilities shall include, among other things, preparation of the municipal budget, and the supervision, direction and control of all departments of the municipal government and its 119 employees, and service on all appointive bodies of the Township; and
WHEREAS, the duly elected Mayor of Vernon Township has served in that full-time position since July 1, 2011, with annual compensation of $30,000.00; and
WHEREAS, annual compensation of $30,000.00 is insufficient remuneration for the Mayor’s full-time service and is not comparable to compensation paid in Sussex County and northern New Jersey for executive and administrative services of this scope and responsibility; and
WHEREAS, the Township Council recognizes that an adjustment in the Mayor’s compensation is necessary and appropriate commensurate with the critical executive and administrative responsibilities of his full-time position.
NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Vernon, County of Sussex and the State of New Jersey, they being the Governing Body thereof, as follows:
Section 1. The annual compensation for the Mayor of Vernon Township shall be $36,000.00 effective January 1, 2015.
Section 2. All ordinances of the Township of Vernon which are inconsistent with the provisions of the Ordinance are hereby repealed to the extent of each inconsistency.
Section 3. If any provision of this Ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect all remaining portions of this Ordinance.
Section 4. This Ordinance shall take effect twenty (20) days after final passage, approval, and publication after adoption by the Township Council and shall be retroactive to January 1, 2015.
