An ordinance of the township council of the Township of Vernon, County of Sussex and state of New Jersey amending certain portions of Chapter 99 entitled “Vehicles and Traffic,” Chapter 250 entitled “Fees And Escrows,” and Chapter 269 entitled “Fire Safety” of the township code

BE IT ORDAINED by the Township Council of the Township of Vernon in the County of Sussex and State of New Jersey that Chapter 99 Entitled “Vehicles and Traffic,” Chapter 250 Entitled “Fees And Escrows,” and Chapter 269 Entitled “Fire Safety” of the Township Code are hereby amended as follows:

SECTION I. Chapter 99 entitled “Vehicles and Traffic” is hereby amended, supplemented, and revised by deleting Section 99-5 in its entirety and replacing same as follows:

§99-5. Violations and penalties.

Unless another penalty is expressly provided by New Jersey statute or otherwise provided for in the Township Code or unless the penalty is expressly set forth in the Local Supplemental Violations Bureau Schedule of the Township of Vernon, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $100 or imprisonment for a term not exceeding 15 days, or both.

SECTION II. Chapter 99 entitled “Vehicles and Traffic” is hereby amended, supplemented, and revised by deleting Section 99-12(D) in its entirety.

SECTION III. Chapter 250 entitled “Fees and Escrows” is hereby amended, supplemented, and revised by deleting Section 250-10 in its entirety and replacing same as follows:

§250-10. Court Clerk.

  1. Traffic Offenses.
    1. Vehicles and Traffic.
      1. §99-7. Parking prohibited at all times: $51.00
      2. §99-8. Parking prohibited during certain hours: $51.00
      3. §99-9. Stopping or standing prohibited during certain hours: $51.00
      4. §99-10. Parking time limited: $51.00
      5. §99-11. Off-street parking: $51.00
      6. §99-12A. Parking prohibited during snow and other emergencies: $51.00
      7. §99-12E. Parking prohibited upon declaration of emergency: $51.00
  2. Non-Traffic Offenses.
    1. Alarms.
      1. §137-6. False alarms.
        1st offense in any single calendar year: warning
        2nd offense in same calendar year: $50
        3rd or subsequent offense in same calendar year: court appearance required plus a fine of not less than $100 nor more than $250 for each occurrence which shall be accompanied by an advisory letter from a licensed alarm company pursuant to §137-11A(3). In the event an advisory letter is not provided, said fine may be increased up to a maximum of $500 in the court’s discretion.
    2. Animals.
      1. §148-8A. Dog license required.
        1st offense: $50 with proof of license.
        2nd offense: $75 with proof of license.
        3rd offense: $100 with proof of license.
        4th or subsequent offense: court appearance required.
      2. §148-8B. Procure replacement dog license tag: $50
      3. §148-8C. Proof of dog rabies inoculation: $50
      4. §148-9. Annual license and metal registration tag required: $50
      5. §148-14. Newly acquired dog attaining licensing age: $50
      6. §148-17A. Removal or wrongful attachment of dog tag: $50

      8. §148-26A. Barking or crying dogs.
        1st offense: $50

      10. §148-26C. Dog to be accompanied and leashed by person more than 12 years of age: $50
      11. §148-28B(1). Rabies vaccination required for all cats: $50
      12. §148-28B(5). Proof of vaccination required for all cats: $50
      13. §148-29B. Dog defecation on private property: $50

SECTION IV. Chapter 269 entitled “Fire Safety” is hereby amended, supplemented, and revised by deleting Section 269-9 in its entirety and replacing same as follows:

§269-9. Parking regulations.

  1. Parking in fire zones and lanes prohibited. Parking of a vehicle or vehicles in any area demarcated by yellow or white lines or signs designating the location of a fire zone or fire lane is prohibited.
  2. Enforcement. The Fire Marshal and the Police Department shall have concurrent jurisdiction to enforce the provisions of this Section.
  3. Violations and penalties. Every person violating this Section shall, upon conviction, be subject to a fine of not less than $75 nor more than $200 and/or community service for up to 30 days.
  4. Removal of vehicle as additional penalty. In the event that any vehicle is parked in violation of a designated fire zone or lane, and, in the opinion of the Police Department or Fire Marshal, the vehicle would substantially impair the ability of emergency services to respond in the event of an emergency, the vehicle may be towed at the owner’s expense.

SECTION V. Chapter 269 entitled “Fire Safety” is hereby amended, supplemented, and revised by deleting Section 269-10 in its entirety and replacing same as follows:

§269-10. Violations and penalties.

Unless otherwise expressly provided for in the Township Code, enforcement, violations and penalties of this Chapter shall be assessed, levied and collected as set forth in the Uniform Fire Safety Act, the Uniform Fire Code (more particularly N.J.A.C. 5:70-2.12, Penalties, and N.J.A.C. 5:70-2.13) and all other applicable laws of the State of New Jersey, as same may be amended.

SECTION VI. If any article, section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this Ordinance and they shall remain in full force and effect.

SECTION VII. In the event of any inconsistencies between the provisions of this Ordinance and any prior ordinance of the Township, the provisions hereof shall be determined to govern. All other ordinances of the Township are hereby ratified and confirmed, except where inconsistent with the terms hereof.

SECTION VIII. This Ordinance shall take effect immediately upon final passage and publication according to law.
