An ordinance amending various sections of the code of the Township of Vernon to correct references to the township manager

WHEREAS, as a result of the change in the form of government, the Township no longer has a Township Manager and the Vernon Township Code has multiple references to a Township Manager,

BE IT ORDAINED by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows:

SECTION 1. The following sections of the Code of the Township of Vernon are modified as follows:

§30-3. Submission of claim. This section is replaced as follows:

The bill of claim duly certified shall be presented to the Mayor for approval of payment.

§30-4. Review of claim; approval method. This section is hereby replaced in its entirety as follows:

Claims shall be considered by the Mayor for approval. If a claim is rejected by the Mayor, it shall be referred to the Chief Financial Officer with any instructions given at the time of disapproval. Generally, the method of approval is as follows:

  1. Encumbrances are to be signed by the Department Head and presented to the Mayor.
  2. If the encumbrance is approved, then it is to be forwarded to the Chief Financial Officer to confirm that the funds are available.
  3. No purchases shall be made if the encumbrance is disapproved or if the funds are not available.
  4. A voucher is to be made out to the vendor with the invoice attached and submitted to the Chief Financial Officer.
  5. Voucher for payment must be approved by the Mayor.
  6. A record of all payments shall be presented to the Township Council at its next regular meeting.

§30-7. Payment of claims and wages by check; certifying and approval officers. The reference to the Township Manager in this section shall be changed to the Mayor.

§30-8. Authorization to disburse claims. This section is hereby deleted in its entirety.

§30-9. Auditing of financial statements. The reference to the Township Manager in this section shall be changed to the Mayor.

§37-7. Municipal Court Administrator. The reference to the Manager shall be replaced with a reference to the Mayor.

§94-1. Division of Police continued; positions. The reference to the Township Manager shall be replaced with a reference to the Mayor.

§94-2. Director of Public Safety; appropriate authority; promulgation of rules and regulations. The reference to the Township Manager shall be replaced with a reference to the Mayor.

§94-5. Requirements for probationary patrolman; appointment. The reference to the Township Manger in paragraph B shall be replaced with a reference to the Mayor.

§94-8. Captains, duties. The reference to the Manager in paragraph A shall be replaced with a reference to the Mayor.

§94-10. Annual physical examinations. The reference to the Manager in paragraph A shall be replaced with a reference to the Mayor.

§94-11. Illness or injury; duties of Township Physician. The reference to the Manager in paragraph E shall be replaced with a reference to the Mayor.

§94-13. Rules and regulations; knowledge of rules and ordinances. The reference to the Manager in paragraph A shall be replaced with a reference to the Mayor.

§130-1. Abandoned properties. Both references to the Township Manager in paragraph C shall be replaced with references to the Mayor.

§130-2. Unfit buildings and nuisances. Both references to the Township Manager in paragraph C shall be replaced with references to the Mayor.

§133-3. Definitions. The reference to the Township Manager in the Housing Administrator definition, paragraph B, shall be replaced with a reference to the Mayor.

§133-7. The reference to the Township Manager in paragraph (b) shall be replaced with a reference to the Mayor.

§133-7. The reference to the Township Manager in paragraph (j) shall be replaced with a reference to the Mayor.

§137-10. Rule-making authority. The reference to the Township Manager shall be replaced with a reference to the Mayor.

§148-18. The references to the Manager and the Township Manager in paragraph C shall be replaced with references to the Mayor.

§148-20. Annual canvass, report. The references to the Manager and the Township Manager shall be replaced with references to the Mayor.

§148-21. Certified Animal Control Officer. The reference to the Manager shall be replaced with a reference to the Mayor.

§148-28. The reference to the Manager in paragraph C(7) shall be replaced with a reference to the Mayor.

§250-5. Township Manager. The reference to the Township Manager shall be replaced with Business Administrator.

§250-17. The reference to the Township Manager in paragraph H(5) shall be replaced with a reference to the Mayor.

§380-3. Assignment of numbers. The first sentence shall be replaced as follows:

Street numbers shall be assigned, placed on the tax records and allotted to the owners of said lands by the Tax Assessor of the Township. [The remaining portion of §380-3 shall not be modified.]

§566-3. Restrictions on water usage upon declaration of emergency; exemption for agriculture operations. The reference to the Township Manager in paragraph A shall be replaced with a reference to the Mayor.

§566-4. Restrictions on burning after declaration of emergency. The reference to the Township Manager shall be replaced with a reference to the Mayor.

§330-5. The definition of Mayor shall be replaced as follows:

MAYOR—The Mayor of the Township of Vernon.

§330-184. In paragraph (1)(a)[2], the reference to the Manager in this paragraph shall be replaced with a reference to the Mayor.

§330-184. In paragraph (1)(c), the references to the Township Manager and Manager in this paragraph shall be replaced with references to the Mayor.

§330-227. Appeals. All references in paragraphs A through D to the Township Manager and Manager shall be replaced with references to the Mayor.

SECTION 2. If any article, section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this Ordinance and they shall remain in full force and effect.

SECTION 3. In the event of any inconsistencies between the provisions of this Ordinance and any prior ordinance of the Township, the provisions hereof shall be determined to govern. All other ordinances of the Township are hereby ratified and confirmed, except where inconsistent with the terms hereof.

SECTION 4. This Ordinance shall take effect immediately upon final passage and publication according to law.
