An ordinance to amend the land development ordinance of the Township of Vernon by adoption of a revised page 1 of the zoning map, Section 330-158 of Chapter 330

WHEREAS, the Township Council of the Township of Vernon find that the first sheet of the Zoning Map of the Township of Vernon, Section 330-158 of Chapter 330 entitled “Zoning Map,” is in need of revision due to errors in the map; and

WHEREAS, it has been brought to the attention of Township Council that Block 184, Lot 18.01 was incorrectly designated as Commercial Resort Zone (C-R Zone) during a zone change in 1998 that changed several parcels in the Mountain Creek Resort Area to the C-R Zone; however Block 184, Lot 18.01 was never identified as one of the parcels to be changed, yet it was incorrectly designated on the adopted map; and

WHEREAS, Block 184, Lot 18.01 was instead intended to remain in the Office Professional Zone (C-3 Zone) as it was designated prior to the zone changes in 1998.

NOW THEREFORE, BE IT ORDAINED by the Township Council of the Township of Vernon, County of Sussex, and State of New Jersey as follows:

Section 1. The Land Development Ordinance of the Township of Vernon is hereby amended by replacing page 1 of the Zoning Map with a revised Zoning Map showing updates as depicted in Attachment 1 of this Ordinance.

Section 2. Should any section, paragraph, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid for any reason by any Court of competent jurisdiction, such provision(s) shall be deemed severable and the remaining portions of this Ordinance shall remain in full force and effect.

Section 3. All ordinances or parts of ordinances or resolutions that are inconsistent with the provisions of this Ordinance are repealed to the extent of such inconsistency.

Section 4. The Township Clerk is directed to give notice at least ten days prior to the hearing on the adoption of this ordinance to the County Planning Board and to all others entitled pursuant to the provisions of N.J.S.A. 40:55D-15. The Township Clerk is further directed to refer this Ordinance to the Vernon Township Land Use Board, pursuant to N.J.S.A. 40:55D-64. Upon the adoption of this ordinance, after public hearing, the Township Clerk is further directed to publish notice of the passage and to file a copy of this ordinance, as finally adopted, with the Sussex County Planning Board, as required by N.J.S.A. 40:55D-16.

Section 5. This Ordinance shall take effect after publication and passage according to law.
