An ordinance of the Township of Vernon, County of Sussex, State of New Jersey, to modify Chapter 142 of the code of the Township of Vernon regarding alcoholic beverages

WHEREAS, Section 142-21 of the Code of the Township of Vernon adopts the provisions of N.J.S.A. 40:48-1.2 pertaining to underage possession or consumption of alcoholic beverages on private property; and

WHEREAS, N.J.S.A. 40:48-1.2a sets forth certain exceptions from prosecution pertaining to underage possession or consumption of alcoholic beverages on private property; and

WHEREAS, the Mayor and the Council of the Township of Vernon, County of Sussex, and State of New Jersey, desire to modify Section 142-21 of the Code of the Township of Vernon to make reference to N.J.S.A. 40:48-1.2a.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and the Council of the Township of Vernon, County of Sussex, and State of New Jersey, that the Code of the Township of Vernon is hereby modified as follows:

SECTION I Section 142-21 of the Code of the Township of Vernon is hereby replaced as follows:

§142-21. Adoption of statutory provisions.
Pursuant to the provisions of N.J.S.A. 40:48-1.2 and N.J.S.A. 40:48-1.2a as amended, the Township of Vernon hereby elects to adopt the provisions of said statutes, copies of which are attached hereto and made a part hereof.

SECTION II Severability. The various parts, sections and clauses of this Ordinance are hereby declared to be severable. If any part, sentence, paragraph, section or clause is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of this Ordinance shall not be affected thereby.

SECTION III Repealer. Any ordinances or parts thereof in conflict with the provisions of this Ordinance are hereby repealed as to their inconsistencies only.

SECTION IV This Ordinance shall take effect upon final passage and publication.
