Minutes: September 26, 2006
Meeting was called to order by Brenda Susman at 7:35 p.m.
Statement of Compliance
The following statement of compliance was read by Brenda Susman.
Pursuant to the Open Public Meetings Act, Chapter 231, P.L. 1975 adequate notice as defined in Section 3D of Chapter 231, P.L. 1975 has been communicated from the Vernon Municipal Center to the New Jersey Herald and published on January 20, 2006. Notice is also posted on the bulletin board and filed with the office of the Township Clerk.

The roll call of members was called and Barrie Beaver, Dennis Downey, Gary Grey and Brenda Susman answered the call.
Open Meeting to the Public
Rich Casper, 40 Curtis Drive; Jerry Levy, 42 Curtis Drive; and Linda Zwolinski, 6 Hidden Valley Drive, all trustees of the Hidden Valley Property Owners Association, addressed the EC. Rich Casper expressed concern over Woodmont Homes’ amended site plan and requested the EC’s support.
Mr. Casper explained that the developer’s exemption from the Highland’s Act was based upon receipt of an LOI which was never submitted. The exemption also stated that if an NJDEP permit was required the exemption would be null and void. Mr. Casper asserted that the developer must follow the Highland’s Act prior to amending the site plan. Mr. Casper suggested the planning board should not review the amended site plan until the Highland’s Act is followed. Gary Grey responded that applications are reviewed by the planning board contingent upon receipt of missing documents, such as an LOI.
The EC, Mr. Casper, Mr. Levy and Ms. Zwolinski reviewed Woodmont Homes’ amended site plan.
Mr. Levy and Mr. Casper requested the EC show a presence at the planning board meeting and also requested the EC schedule a site inspection.
Approval of Meeting Minutes
Gary Grey made a motion to approve the September 12, 2006 minutes as amended; Dennis Downey seconded the motion.
Applications Under Review
PB #10-06-14: Woodmont Homes, Inc.—Amendment to Final Major Subdivision (PB #7-03-10)
The EC reviewed the application and agreed on the following concerns:
- The ESAs are not delineated. The amended application should conform to the current ESA ordinance.
- The application requires soil logs for the new proposed seepage pit area.
- The EC agreed receipt of the LOI is critical.
- The Storm Water Management Plan only addresses 15 acres, however, the project area appears to be larger.
- Is the amended application required to conform to the current Storm Water Management requirements? If so, does it conform?
PB #10-06-13: James Smith—Lot Line Relocation
The EC agreed the application does not create significant environmental impact.
PB #4-05-4: Highland Lakes Real Estate—Preliminary Major Subdivision
The EC reviewed the application on September 12, 2006 and the concerns remain the same.
- The application requires more detailed soil logs.
- Steep slope issues exist.
- The application requires an LOI and an environmental impact statement.
- Lots 7, 8 and 9 have substandard improvable area due to ESAs.
Planning Board Liaison Report
David Gornstein was not present at tonight’s meeting.
Shade Tree Ordinance
The EC approved the draft of the letter addressed to the town council which will serve as an introduction to the shade tree ordinance.
Brenda Susman reported the NRI has been approved by the planning board. Dennis Downey suggested the NRI should be checked for items requiring updating. Gary Grey suggested the NRI should be made accessible to the public.
There being no further items of business for the regular meeting, a motion was made by Dennis Downey to adjourn the meeting; Barried Beaver seconded the motion. The regular meeting of the Vernon Township Environmental Commission was adjourned at 9:20 p.m.
