Minutes: October 10, 2006

Meeting was called to order by Craig Williams at 7:43 p.m.

Statement of Compliance

The following statement of compliance was read by Craig Williams.

Pursuant to the Open Public Meetings Act, Chapter 231, P.L. 1975 adequate notice as defined in Section 3D of Chapter 231, P.L. 1975 has been communicated from the Vernon Municipal Center to the New Jersey Herald and published on January 20, 2006. Notice is also posted on the bulletin board and filed with the office of the Township Clerk.

Roll Call

The roll call of members was called and Dennis Downey, Michael Furrey, David Gornstein (arrived 8:06 p.m.), Gary Grey (arrived 7:58 p.m.), Brenda Susman, and Craig Williams answered the call.

No members of the public were present.

Approval of Meeting Minutes

Brenda Susman made a motion to approve the September 26, 2006 minutes; Dennis Downey seconded the motion.

Applications Under Review

ZB #10-06-17: Sally Rinker—Use Variance, Preliminary and Final Major Subdivision

The EC reviewed the application which requests the benefits of the Residential Cluster Development Open Space Provisions. Under said provisions a minimum of 50% of the remaining open space shall not be constrained by wetlands, flood plains, steep slopes or other limiting features. The application also requests a waiver from section 7-17 of the Land Development Ordinance.

The EC agreed the application does not include many steep slope issues, however, it does include substantial wetlands issues.

Brenda Susman suggested the application requires an environmental impact statement.

The EC agreed the application must disclose the date of the test pits. Also, the application lacks watertable information and flooding information.

Craig Williams suggested the EC schedule a site inspection.

Planning Board Liaison Report

David Gornstein reported the NRI was approved by the planning board as a resource document.

The EC agreed to speak to Don Teolis about adding the NRI to the Vernon Website.

New Business

Hidden Valley Property Owners

David Gornstein provided a copy of a letter from the Hidden Valley Property Owners’ Association’s attorney dated October 6, 2006 to Stuart Koenig regarding the Whispering Woods application. Said letter objects to the application.

David Gornstein will provide a copy of the September 26, 2006 Environmental Commission minutes to the planning board and he will advise the planning board that the EC is requesting time at the October 25, 2006 planning board meeting to discuss the Whispering Woods application.

Highlands Real Estate

David Gornstein reported that the planning board received a letter from the county which advised that the county has denied the current Highlands Real Estate application.


Dennis Downey reported that Dan Segal is resigning as the Earthfest chairman. The EC discussed Earthfest.

Black Creek Project

Michael Furrey reported he spoke with Gene Osias who advised that the township would like to add more sophisticated types of testing to identify the origin of the points of pollution. Any testing will begin next March or April. The DEP must approve additional funding and locate approved labs.

Old Business

Shade Tree Ordinance

Brenda Susman reported she provided Don Teolis with the shade tree ordinance and the EC’s introduction letter. There was no response to date.

Wallkill Wildlife Refuge Open House

The Open House will be held Saturday, October 14 from 1:00 to 5:00. David Gornstein reported there will be “environmentally friendly” vendors and tours of the refuge. The Vernon Rotary Club will be supervising parking.

The EC discussed their table at the event.


There being no further items of business for the regular meeting, a motion was made by David Gornstein to adjourn the meeting; Gary Grey seconded the motion. The regular meeting of the Vernon Township Environmental Commission was adjourned at 9:17 p.m.
