Minutes: July 25, 2006

Meeting was called to order by Craig Williams at 7:50 p.m.

Statement of Compliance

The following statement of compliance was read by Craig Williams.

Pursuant to the Open Public Meetings Act, Chapter 231, P.L. 1975 adequate notice as defined in Section 3D of Chapter 231, P.L. 1975 has been communicated from the Vernon Municipal Center to the New Jersey Herald and published on January 20, 2006. Notice is also posted on the bulletin board and filed with the office of the Township Clerk.

Roll Call

The roll call of members was called and Barrie Beaver, Michael Furrey, David Gornstein, Brenda Susman and Craig Williams answered the call.

Approval of Meeting Minutes

As follow-up to a discussion recorded in the July 11, 2006 minutes, Craig Williams reported that he questioned the public’s notification of scheduled mosquito spraying. He requested the town alert the public via the township’s e-mail alert. The town’s response was to enroll on the county website for the county’s e-mail alert.

David Gornstein made a motion to approve the July 11, 2006 minutes, Michael Furrey seconded the motion.

Open Meeting to the Public

No members of the public were present.

Applications Under Review

ZB #5-06-9: Surjit Singh—Variance to Construct Canopy & Site Plan

The EC agreed the application does not create significant environmental impact.

PB #9-03-14: Vest-In-Land—Revised Final Subdivision

The application included an LOI. The EC reviewed the test pits and found the test pits were not adequately defined. The soil logs indicated that one of the test pits is indicative of high water table, an ESA. The EC will request further information to define the test pit and its location on the plan.

PB #7-05-7: JD Vernon Lodge & Inn LLC—Revised Final Site Plan

The EC agreed the application does not create significant environmental impact.

Craig Williams commented that revised applications should distinguish the revision from the original application. David Gornstein advised that he will comment to the planning board that the EC would like to see the revisions detailed/highlighted on the plans.

Planning Board Liaison Report

David Gornstein reported the planning board meeting was cancelled.

Old Business

Crystal Springs Site Inspection

The EC site inspection is scheduled for Saturday, August 5, 2005

ESA Ordinance

Craig Williams provided the EC members with a copy of a response letter to the town council indicating the EC’s acceptance of the revised ESA ordinance.

Shade Tree Ordinance

Brenda Susman reported she e-mailed Lou Kneip requesting the status of the ordinance. She has not received a response to date.

Whispering Woods

Craig Williams advised that the developers, Larry and Robert Handler, were present at the town council meeting with their attorney to make a presentation regarding their pro-active response to the situation at Whispering Woods. Craig Williams further advised that the town council responded with dissatisfaction of the development.


The EC discussed the status of the planning board’s review of the NRI and discussed requesting the planning board finalize their review.

Mountain Resort Zone Ordinance

The EC reviewed a letter drafted by Michael Furrey to the town council addressing various issues of the Mountain Resort Zone ordinance such as steep slopes, the Black Creek, lot coverage, and the visual impact of building height.

New Business

Mountain Creek

Craig Williams advised the EC they received notification that Mountain Creek has applied for an LOI.


There being no further items of business for the regular meeting, a motion was made by Barrie Beaver to adjourn the meeting; David Gornstein seconded the motion. The regular meeting of the Vernon Township Environmental Commission was adjourned at 9:27 p.m.
