Minutes: February 14, 2006
Meeting was called to order by Craig Williams at 7:38 p.m.
Statement of Compliance
The following statement of compliance was read by Craig Williams.
Pursuant to the Open Public Meetings Act, Chapter 231, P.L. 1975 adequate notice as defined in Section 3D of Chapter 231, P.L. 1975 has been communicated from the Vernon Municipal Center to the New Jersey Herald and published on January 20, 2006. Notice is also posted on the bulletin board and filed with the office of the Township Clerk.

The roll call of members was called and Dennis Downey, David Gornstein, Brenda Susman and Craig Williams answered the call.
Approval of Meeting Minutes
Dennis Downey made a motion to approve the January 24, 2006 minutes; David Gornstein seconded the motion.
Open Meeting to the Public
No members of the public were present.
Applications Under Review
ZB #2-06-2: Gino Misciagna—Variance for Stream Buffer Setback
To be carried to the next meeting.
PB #2-06-1: Michael Pappa—Revised Minor Site Plan
The EC is concerned the plan is within the wetlands buffer. The wetlands buffer needs to be delineated. The stream corridor protective setbacks need to be shown. The application requires an LOI. The HPC agreed to a site inspection on Saturday, February 18, 2006.
PB #9-05-11: Festival Fun Parks, LLC—Revised Preliminary & Final Site Plan
The EC agreed the application did not create significant environmental impact.
Planning Board Liaison Report
David Gornstein reported the PB is still awaiting a response from the PB committee responsible for reviewing the NRI.
Susan Kubie, Block 134, Lot 17
EC received a copy of a letter requesting an LOI.
Hidden Valley Ski Resort
EC received a copy of a letter questioning Highlands Act applicability.
- Attorney for Hidden Valley Property Owners’ Association to Lawrence Handler dated December 15, 2005. Letter addressed soil erosion and discrepancies in plan.
- Hidden Valley Property Owners’ Association to the New Jersey DEP dated January 24, 2006. Letter addressed lack of notification to property owners during approval process, lack of discussion/reference of the lake and surrounding watershed during the approval process, lack of sediment control during the construction process and adverse storm water runoff conditions.
- Jerry Levy to Lou Kneip dated January 31, 2006. Letter addressed addition of third detention basin to mitigate the uncontrolled runoff.
David Gornstein will convey to the PB the EC’s concern with the continued development of the Upper Plateau and question the PB what steps can be taken to remedy the situation.
Shade Tree Ordinance
The EC reviewed and discussed the Sparta Township tree ordinance. The EC agreed to work with Fred Suljic and follow the Sparta Township tree ordinance as an example while drafting a tree ordinance for Vernon.
The EC discussed requesting funds from the township for the Earthfest. Brenda Susman reported the photography contest has been discussed with the schools. The EC agreed to discuss the EC Earthfest table at the next meeting.
A&P Plaza Waste Disposal
Notice was forwarded to the shopping center management company and the Board of Health regarding garbage behind the plaza.
There being no further items of business for the regular meeting, a motion was made by Dennis Downey to adjourn the meeting; David Gornstein seconded the motion. The regular meeting of the Vernon Township Environmental Commission was adjourned at 9:17 p.m.
