Minutes: December 12, 2006

Meeting was called to order by Craig Williams at 7:52 p.m.

Statement of Compliance

The following statement of compliance was read by Craig Williams.

Pursuant to the Open Public Meetings Act, Chapter 231, P.L. 1975 adequate notice as defined in Section 3D of Chapter 231, P.L. 1975 has been communicated from the Vernon Municipal Center to the New Jersey Herald and published on January 20, 2006. Notice is also posted on the bulletin board and filed with the office of the Township Clerk.

Roll Call

The roll call of members was called and Dennis Downey, David Gornstein, Gary Grey and Craig Williams answered the call.

Open Meeting to the Public

No members of the public were present.

Approval of Meeting Minutes

Dennis Downey made a motion to approve the November 28, 2006 minutes; David Gorntein seconded the motion.

Applications Under Review

ZB #10-06-17: Sally Rinker—Use Variance, Preliminary and Final Major Subdivision and Existing & Proposed Drainage Areas

The EC reviewed the application and agreed the application which requests consideration as a cluster development does not conform to the requirements for cluster developments. In addition, the EC was concerned that the plans propose the township take ownership of the detention ponds.

PB #4-05-4: Highland Lakes Real Estate—Revised Subdivision Plans & Storm Water Source Control Plan Calculations

The EC previously reviewed the application at the September 12, 2006 and September 26, 2006 EC meetings. The EC agreed the concerns remain the same specifically in the areas of steep slope and soil issues.

PB #10-06-14: Woodmont Homes—Revised Map for Amended Final Major Subdivision—PB #7-03-10

The EC agreed on the following:

  1. The application still lacks an LOI.
  2. Detention basins number 1 and 2 will not be effective as currently designed due to the amount of natural spring water which is always present.
  3. The application lacks soil logs.

Old Business

Tree Ordinance

David Gornstein suggested that the EC should be responsible for drafting a shade tree ordinance and restrictions on clear-cutting should be handled by the planning board or the building department.

Craig Williams and David Gornstein discussed the possibility of the building department regulating clear-cutting.

Craig Williams stated that two ordinances should be written. A shade tree ordinance for the preservation and enhancement of shade trees and a clear-cutting ordinance stating restrictions and regulations.

Draft Resolution re: Environs

The EC reviewed the Town Center application. The EC agreed to provide the town council with the application attached to the Environ letter.

Attachment of the Town Center application will serve as a reminder of the town council’s prior commitment to the environment and open space.

Gypsy Moth Spray Program

The EC agreed the program should proceed.

Adjournment

There being no further items of business for the regular meeting, a motion was made by David Gornstein to adjourn the meeting; Dennis Downey seconded the motion. The regular meeting of the Vernon Township Environmental Commission was adjourned at 10:18 p.m.
